RIGHTS WAIVER. The rights and remedies available to each of us are cumulative and in addition to, not exclusive of or in substitution for, any rights or remedies that are otherwise available. No breach of this License will be waived except with the express written consent of the one of us who is not in breach who may make such a waiver upon notice to the other. Neither the failure to require the performance of any term or obligation of this License or the waiver of any breach hereof shall prevent any subsequent enforcement of such term or obligation or be deemed a waiver of the same.

  • Xx Waiver Neither a failure nor a delay on the part of either the Trustee or the Holders in exercising any right, power or privilege under this Article 11 shall operate as a waiver thereof, nor shall a single or partial exercise thereof preclude any other or further exercise of any right, power or privilege.
