Rights to Materials. All records, files, memorandum, reports, drawings, documents, and the like (together with all copies thereof) relating to the business of the Company, which you will use or prepare or come into contact within the course of, or as a result of, your employment shall, as between the parties hereto, remain the sole property of the Company. Upon your termination/separation from the Company you shall return all such materials to the Company and agree that you shall not thereafter cause removal of such materials from the premises of the Company.

Rights to Materials. [Not Applicable to Agreements issued either in whole in part for Information Technology, as defined in CRS § 24-37.5-102(2); in which case Addendum 1 §2 applies in lieu of this section.] Unless specifically stated otherwise in this Agreement, all materials, including without limitation supplies, equipment, documents, content, information, or other material of any type, whether tangible or intangible (collectively “Materials”), furnished by the State to Grantee or delivered by Grantee to the State in performance of its obligations under this Agreement shall be the exclusive property the State. Grantee shall return or deliver all Materials to the State upon completion or termination of this Agreement.

Upon termination of this Agreement or upon the prior demand of either Company, Consultant shall immediately return all such materials to the Company to which such materials belong.

Rights to Materials. The written reports and other written materials furnished by Consultant to POCI in connection with the performance of consulting services hereunder shall remain the exclusive property of POCI. Therefore, Consultant agrees to promptly return, following the termination of this Agreement or upon earlier request by POCI, any written materials in Consultant’s possession supplied by POCI in conjunction with Consultant’s services under this Agreement or generated by Consultant in performance of consulting services under this Agreement.
