Common use of Rights of Access Clause in Contracts

Rights of Access. Prior to the issuance of the Release of Construction Covenants, for purposes of assuring compliance with this Agreement, representatives of Agency shall have the right of access to the Agency Parcels, without charges or fees, at normal construction hours during the period of construction for the purpose of ensuring compliance with this Agreement, including but not limited to, the inspection of the work being performed in the construction of the Improvements so long as Agency representatives comply with all safety rules and, at Developer’s option, are escorted by a representative of Developer. Agency (or its representatives) shall, except in emergency situations, notify the Developer prior to exercising its rights pursuant to this Section.
