Common use of Rights as a Bank Clause in Contracts

Rights as a Bank. With respect to its Commitment and the Loans made by it, Chase (and any successor acting as Administrative Agent) in its capacity as a Bank hereunder shall have the same rights and powers hereunder as any other Bank and may exercise the same as though it were not acting as the Administrative Agent, and the term "Bank" or "Banks" shall, unless the context otherwise indicates, include the Administrative Agent in its individual capacity. Chase (and any successor acting as Administrative Agent) and its affiliates may (without having to account therefor to any Bank) accept deposits from, lend money to, make investments in and generally engage in any kind of banking, trust or other business with the Company (and any of its Subsidiaries or affiliates) as if it were not acting as the Administrative Agent, and Chase (and any such successor) and its affiliates may accept fees and other consideration from the Company for services in connection with this Agreement or otherwise without having to account for the same to the Banks.

With respect to its Commitment and the Loans made by it, Chase Bank of America (and any successor acting as Administrative Agent) ), in its capacity as a Bank hereunder hereunder, shall have the same rights and powers hereunder as any other Bank and may exercise the same as though it were not acting as the Administrative Agent, and the term "“Bank" ” or "“Banks" ” shall, unless the context otherwise indicates, include the Administrative Agent in its individual capacity. Chase Bank of America (and any successor acting as Administrative Agent) and its affiliates may (without having to account therefor to any Bank) accept deposits from, lend money to, make investments in and generally engage in any kind of banking, trust or other business with the Company Borrower (and any of its their Subsidiaries or affiliates) as if it were not acting as the Administrative Agent, and Chase (and any such successor) Bank of America and its respective affiliates may accept fees and other consideration from the Company Borrower for services in connection with this Agreement or otherwise without having to account for the same to the Banks.
