Rights and Protection in Representation. Pursuant to Chapter 123, Public Laws of 1974, the Board hereby agrees that every employee of the Board shall have the right freely to organize, join and support the Association for the purpose of engaging in collective negotiations and other Association activities for mutual aid and protection, except strikes, walk-outs and the like. As a body exercising government power under color of law of the State of New Jersey, the Board undertakes and agrees that it shall not directly or indirectly discourage, deprive or coerce any employee in the enjoyment of any rights conferred by Chapter 123, Public Laws of 1974, or other laws of New Jersey or the Constitutions of New Jersey and the United States; that it will not discriminate against any employee with respect to hours, wages or any terms or conditions of employment by reason of his membership in the Association; his participation in any activities of the Association (except as limited above); collective negotiations with the Board or his institution of any grievance complaint or proceeding pursuant to this Agreement.

The Board further agrees that it shall not directly or indirectly discourage, encourage, deprive or coerce any employee in the enjoyment of any rights conferred by this Agreement, Laws of Florida or the Constitution of Florida and the United States; that it shall not discriminate against any employee with respect to hours, wages, or terms and conditions of employment by reason of membership in the Association participation in any activities of the Association or collective bargaining with the Board, or the institution of any grievance, complaint or proceedings under this Agreement or Law or otherwise with respect to any terms or conditions of employment.

The Board agrees that it shall not discourage nor deprive or coerce any employee in the enjoyment of any rights conferred by Chapter 123, Public Laws of 1974, and that it shall not discriminate against any member of the bargaining unit respect to hours, wages, or terms and conditions of employment by reason of his membership or non-membership in the Association and its affiliates.

The Board agrees that it shall not directly or indirectly discourage or deprive any employee of the Association Unit any rights conferred by Chapter 123, Public Laws of 1974, State of New Jersey, or any other laws of New Jersey or the Constitution of New Jersey and the United States. The Board further agrees that it shall not discriminate against any employee of the Association Unit with respect to term and conditions of employment by reason of membership in the Association or in the exercise of any rights conferred by this Agreement in respect to any terms of employment.

Pursuant to chapter 15.1-16 of the North Dakota Century Code, the Board hereby agrees that every teacher employed by the Board shall have the right to organize, to join, and to support the Association and its affiliates for the purpose of professional negotiations and other concerted activities for mutual aid and protection. As a duly selected body exercising governmental power under the laws of North Dakota, the Board agrees that it shall not directly or indirectly discourage, deprive, or coerce any teacher in the enjoyment of any rights conferred by 15-38.1, other laws of North Dakota, or the Constitution of North Dakota or the United States; that it shall not discriminate against any other teacher with respect to hours, salary, or any terms of conditions of employment by reason of his/her membership in the Association or its affiliates, professional negotiations with the Board, or his/her institution of grievance, complaint, or proceeding under the provisions of this Agreement or otherwise with respect to any terms or conditions of employment.
