Common use of Right to Vary Clause in Contracts

Right to Vary. Subject to clause 3.1 the Engineer may instruct any additional, or varied works and/or any omission of any Works at any time before the Certificate of Substantial Completion. Following any omission of any Works the Contract Price shall be reduced and the Completion Date and Schedule for Completion changed on a reasonable basis as is assessed by the Engineer and notified to the Contractor following the omission, and the Contractor shall not be entitled to any loss or expense or any other payment as a result of or in connection with any omission, including without limitation if the omitted Works are carried out by UNICEF or any third party.
