Right to Resort to Provisional Remedies Preserved. To the extent permitted by applicable law, nothing herein will be deemed to limit or constrain our right to resort to self-help remedies, to interplead funds in the event of a dispute, to exercise any security interest or lien we may hold in property, or to comply with legal process, or to obtain provisional remedies such as injunctive relief, attachment, or garnishment by a court having appropriate jurisdiction; provided, however, that you or USB may elect to arbitrate any dispute related to such provisional remedies. Severability and Survival of Terms If any provision in this Arbitration and Waiver of Class Action section is found to be invalid, unenforceable, or inapplicable by the arbitrator or a court of competent jurisdiction, the remaining provisions of this Arbitration and Waiver of Class Action section will remain in full force and effect notwithstanding the invalid, unenforceable, or inapplicable provision. The provisions of this section shall survive the termination of the Agreement, your Accounts with USB, or your relationship with USB.
