Common use of Right to Reopen Clause in Contracts

Right to Reopen. ‌ If any court of competent jurisdiction rules that compensation limitations imposed by state law have no effect, and/or provides increased flexibility to the local school district to allow additional compensation for their employees, then the Association shall have the right to reopen negotiations on salary, hourly rates, stipend, and benefit provisions contained herein. This right to reopen shall be available to the Association in the event that legislative actions provide increased flexibility to local school districts to allow additional compensation for their employees. Pending the outcome of such negotiations, salaries shall continue to be paid in accordance with the provisions above. Any additional increase or decrease in salaries resulting from such reopened negotiations shall be applied retroactively to the beginning of the employment year.
