Right to Reject Work Sample Clauses

Right to Reject Work. Owner Parties shall have the authority to reject Work that does not conform to the Contract Documents and to require special inspection or testing of any Work. However, neither Owner Parties’ authority to act under this Section, nor any decision made by them in good faith, shall give rise to any duty to Contractor, Subcontractor, Sub-subcontractor or any other person performing Work. Work that is Defective Work, in Owner Parties’ reasonable judgment, shall be removed from the Site, corrected, and repaired, at Contractor’s expense. Work completed or Materials installed that are subject to inspection or testing under the Contract Documents but for which Contractor failed to properly inspect, test, or timely notice Owner Parties, may be ordered removed by Owner Parties at Contractor’s expense.

Right to Reject Work. Owner will have the right to reject Work that does not conform to the Contract Documents. Owner may require special inspection or testing of the Work to determine if the Work is non-conforming. If the Work is found to be conforming, the cost of inspection or testing will be charged to Owner and an appropriate Change Order issued. If such Work is found to be non-conforming, Construction Manager will pay the cost of correction, inspection or testing.
Right to Reject Work. Regardless of whether payment has been made therefore, Owner shall have the right to reject any portion of the Work that contains any Defect. Upon such rejection, Contractor shall promptly remedy, at its sole cost and expense, any Defect that is identified by Owner as giving rise to such rejection.
Right to Reject Work. Without limiting Owner’s right to make a warranty claim hereunder for Defective Work (or other uncompleted Work) discovered after Substantial Completion, regardless of whether payment has been made therefor, Owner shall have the right to reject any portion of the Work that contains any Defect unless the same constitutes a Non-Critical Deficiency at the time of Substantial Completion. Upon such rejection, Contractor shall remedy, at its sole cost and expense, any such Defect that is identified by Owner as giving rise to such rejection.
