Right of the Employer. The Union further recognizes the right of the Employer to operate the Kenora-Rainy River Districts Child and Family Services in all respects in accordance with its commitments, obligations and responsibilities under the Child, Youth and Family Services Act, or any other Act of the Government of Canada or the Province of Ontario, or any other applicable act, to serve the needs of the public at large.

Right of the Employer. Subject to the terms of this Agreement and without restricting the rights of the employees under the terms of this Agreement, the Union recognizes the right of the Employer to manage its affairs and operations and to direct its working forces, including the right to discipline or suspend or discharge for proper cause, and the right to hire, promote, assign work, demote, layoff, determine job content and evaluate jobs, and the foregoing shall not be deemed to exclude other functions of management not specifically covered in this Agreement. The Employer shall not exercise its rights to direct the working forces in a discriminatory manner.
Right of the Employer a) The Employer reserves the right to have a new employee examined by a physician during their probationary period. Thereafter, they may have the employee examined for follow- up. The employee shall be informed of all results, comments and recommendations of the physician.
