Common use of Right of Subrogation Clause in Contracts

Right of Subrogation. Upon making any payment to an Indemnified Party in respect of any Losses, the Indemnifying Party shall, to the extent of such payment, be subrogated to all rights of the Indemnified Party against any third party in respect of the Losses to which such payment relates. Such Indemnified Party and Indemnifying Party shall execute upon request all instruments reasonably necessary to evidence or further perfect such subrogation rights.

Right of Subrogation. Upon making any payment to by an Indemnifying Party of an Indemnified Party in respect of any LossesAmount, the Indemnifying Party shall, with respect to the extent of such paymentamount paid, be subrogated to all causes of action, rights of recovery and/or enforcement rights that the Indemnified Party against may have under any third party contract, agreement, instrument or understanding (other than this Agreement and the other agreements entered into in respect of the Losses connection herewith) to which such payment relates.
