Returning from Leave of Absence. The employee must be qualified to resume his regular duties upon return to work from an approved Leave of Absence. A doctor's certificate verifying that the employee is able to resume his normal duties may be required. The employee shall be returned to the job previously held, or to a job comparable with regard to rate of pay no later than on the first weekly schedule, provided the notice of intent to return to work is received prior to 9:00 am, Wednesday of the week preceding the next available schedule.

Returning from Leave of Absence. No employee shall be entitled to reemployment after having used all of his/her accrued sick and emergency leave, except as herein otherwise provided. All such employees shall, however, be given consideration for employment in a position for which they are qualified.
Returning from Leave of Absence. Any teacher who is on leave of absence who wishes to return to his/her teaching duties at the beginning of the school year shall notify the Superintendent or his/her designee in writing of such intention no later than March 1, preceding the commencement of the next school year. Any teacher who takes a leave of absence shall be guaranteed the return to a comparable teaching position held prior to such leave. If notice is not received by March 1, it is assumed that the person on leave of absence has no desire to return, thereby terminating the leave and employment.
Returning from Leave of Absence. Employees returning from a leave of absence because of illness or injury may be required to undergo a medical examination by, and receive the approval of, a MetroParks-designated physician before being permitted to return to work. If such an examination is required, it shall be paid for by MetroParks.

Returning from Leave of Absence. An employee who has been on an extended leave of absence in excess of ninety days will, if he/she has given the thirty (30) days notice of return, have the right to any vacancy available in the curricular or subject area for which said employee is qualified, certified, and endorsed as to grade level, and approved as to subject matter. If there is no such vacancy, then seniority permitting the District will lay off, effective for the following school year, the least senior employee in a position for which the returning employee is certified, endorsed and approved.

However, provided a vacancy exists for which the employee is qualified, the 37 employee shall be reinstated to a position equivalent in duties and salary to that held at the time the 38 request for leave of absence was approved. Failure to respond by April 1st will 40 result in separation of employment. 42 If a vacancy does not exist equivalent in duties and salary, a layoff consistent with other provisions of 43 this Agreement will be instituted to create an appropriate position. 44

Returning from Leave of Absence. The returning employee will be assigned to the position occupied before the leave of absence. Employees hired to fill positions of employees on leave of absence will be hired for a specific time, during which they shall be subject to all provisions of this Agreement. It shall be the responsibility of the employer to inform replacement employees of these provisions.

Any person returning from an extended leave of absence for personal illness for a period no longer than six (6) months to a protected job as stipulated in Paragraph 8.9, shall be placed in his/her former classification, job, position and pay. An employee’s job will be held (protected) without posting for a total of no more than six (6) months in any 12-month period. This paragraph is not intended to guarantee a position if the position is eliminated by the Board. Any person returning from a Workers' Compensation leave of less than one (1) year shall be placed in his/her former classification, job, position and pay. Employees absent from work on health leave (including Workers' Compensation) whose positions are no longer protected, shall be returned to work within thirty (30) days of providing written notice to the Office of Human Resources/Legal Affairs of ability to return to work accompanied by a Doctor's Verification Form in Appendix F releasing the employee to return to work.
