Common use of Return of Capital Clause in Contracts

Return of Capital. Except as otherwise provided in this Agreement, no Partner shall withdraw any Capital Contributions or any money or other property from the Partnership without the written consent of the other Partners. Under circumstances requiring a return of any Capital Contributions, no Partner shall have the right to receive property other than cash, unless otherwise specifically agreed in writing by the Partners at the time of such distribution.

Return of Capital. Except as otherwise provided in this Agreement, no Partner shall withdraw any Capital Contributions capital contributions or any money or other property from the Partnership portion of such Partner’s Capital Account without the written consent of the other PartnersPartner. Except as otherwise expressly provided in this Agreement, no Partner shall withdraw including, without limitation, any Capital Contributions or any money or other property from the Partnership without the written consent of the other Partners. Under circumstances requiring a return of any Capital Contributionsamendments hereto in accordance with Section 12.2, no Partner shall have priority over any other Partner, either as to the right return of Capital Contributions or as to receive property other than cashprofits, unless otherwise specifically agreed in writing by the Partners at the time of such distributionlosses or distributions.
