Common use of Resubmission of Notice for Payment Clause in Contracts

Resubmission of Notice for Payment. If the Policy Provider at any time informs the Subordination Agent in accordance with the Policy that a Notice for Payment or Notice of Avoided Payment submitted by the Subordination Agent does not meet the requirements of the Policy, the Subordination Agent shall, as promptly as possible after being so informed, submit to the Policy Provider an amended and revised Notice for Payment or Notice of Avoided Payment, as the case may be, and shall pay to the Class G Trustee out of the Policy Account the amount received pursuant to such amended or revised Notice for Payment or Notice of Avoided Payment, as the case may be, when received.

Resubmission of Notice for Payment. If the Policy Provider at any time informs the Subordination Agent in accordance with the Policy that a Notice for Payment of Nonpayment or Notice of Avoided Payment submitted by the Subordination Agent does not meet satisfy the requirements of the Policy, the Subordination Agent shall, as promptly as possible after being so informed, submit to the Policy Provider an amended and revised Notice for Payment of Nonpayment or Notice of Avoided Payment, as the case may be, and shall pay to the Class G Trustee out of the Policy Account the amount received pursuant to such amended or revised Notice for Payment of Nonpayment or Notice of Avoided Payment, as the case may be, when received.

If the any Policy Provider at any time informs the Subordination Agent in accordance with the its respective Policy or Policies that a Notice for Payment or Notice of Avoided Payment submitted by the Subordination Agent does not meet the requirements of the Policysuch Policy or Policies, the Subordination Agent shall, as promptly as possible after being so informed, submit to the such Policy Provider and its Fiscal Agent an amended and revised Notice for Payment or Notice of Avoided Payment, as the case may be, and shall pay to the Class G Senior Trustee out of the applicable Policy Account Account(s) the amount received pursuant to such amended or revised Notice for Payment or Notice of Avoided Payment, as the case may be, when received.
