Restrictive Agreements Prohibited. Neither the Company nor any of its subsidiaries, if any, shall become a party to any agreement which, by its terms, restricts the Company’s ability to perform under or comply with the terms of this Agreement, the Ancillary Agreements to which the Company is a party or the Charter.

Restrictive Agreements Prohibited. Neither the Company nor any of its subsidiaries shall become a party to any agreement that by its terms restricts the ability of the Company to perform its material obligations under any of the Transaction Documents.
Restrictive Agreements Prohibited. The Company shall not become a party to any agreement which by its terms restricts the performance thereby of this Agreement, the Amended Charter or the Stockholders' Agreement, as applicable.
