Restrictions on Use of the Services. You agree not to use or permit use of the services, including by uploading, emailing, posting, publishing or otherwise transmitting any material, for any purpose that may (a) menace or harass any person or cause damage or injury to any person or property, (b) involve the publication of any material that is false, defamatory, harassing or obscene, (c) violate privacy rights or promote bigotry, racism, hatred or harm, (d) constitute unsolicited bulk e-mail, “junk mail”, “spam” or chain letters; (e) constitute an infringement of intellectual property or other proprietary rights, or (f) otherwise violate applicable laws, ordinances or regulations. In addition to any other rights afforded to SkillsTX under the agreement, SkillsTX reserves the right to remove or disable access to any material that violates the foregoing restrictions. SkillsTX shall have no liability to you in the event that SkillsTX takes such action. You agree to defend and indemnify SkillsTX against any claim arising out of a violation of your obligations under this section.
Restrictions on Use of the Services. 3.1. You agree that you are responsible for your own conduct while accessing or using the Services and for any consequences thereof. You agree to use the Services only for purposes that are legal, proper and in accordance with these Terms and any applicable laws or regulations. By way of example, and not as a limitation, you may not and may not allow any third party to: ● send, upload, distribute or disseminate or offer to do the same with respect to any unlawful, defamatory, harassing, abusive, fraudulent, obscene, or otherwise objectionable content; ● distribute viruses, worms, defects, Trojan horses, corrupted files, hoaxes, or any other items of a destructive or deceptive nature; ● upload, post, transmit or otherwise make available through the Service any content that infringes any patent, trademark, copyright, trade secret or other proprietary right of any party, unless you are the owner of such rights or have the permission of the owner to post such content; ● use the Services to violate the legal rights (such as rights of privacy and publicity) of others, including your customers, or send through the Services any content, which is unauthorized or unsolicited advertising, junk or bulk e-mail; ● carry on any unlawful businesses and activities such as, for example: (i) creation, sale or distribution of sites offering services such as prostitution, escorts; (ii) fraudulent business, sale of counterfeit or stolen items or the sale of goods or service that are illegally imported or exported; (iii) sale of narcotics, illegal substances or controlled substances, any equipment for making or using such drugs; (iv) pyramid schemes, high risk investments schemes and other business that we determine in our sole discretion to be unfair, deceptive or predatory towards consumers; (v) any business that we believe poses elevated financial risk, illegal liability, or violates the law of sender or recipient of payment; ● modify, adapt or reverse engineer any portion of the Website or any software used for providing Services; ● remove any copyright, trademark or other proprietary rights notices contained in or on the Website or any content posted thereon; ● display any content through the Services that contains any hate-related or violent information or contains any other material, products or services that violate or encourage conduct that would violate any criminal laws, any other applicable laws, or any third party rights; ● use any robot, spider, site search/retriev...

In addition to any other rights afforded to Workwell Technologies under the agreement, Workwell Technologies reserves the right to remove or disable access to any material that violates the foregoing restrictions. Workwell Technologies shall have no liability to you in the event that Workwell Technologies takes such action. You agree to defend and indemnify Workwell Technologies against any claim arising out of a violation of your obligations under this section.

In using the Synapse-Enabled Services, you represent and warrant that you are at least 18 years old (or are of at least the legal age of capacity applicable in your jurisdiction), and that you have the right, authority, and capacity to enter into these Terms of Service. If you are accepting these Terms of Service on behalf of any legal entity, including any company, organization, government, or governmental agency, you represent and warrant that you have been duly authorized to do so, and that you act on behalf of any such legal entity.

Partner acknowledges and agrees that Partner’s use of any Services provided to Partner in connection with Partner’s activities hereunder is governed by the terms of the Master Service Agreement found at xxxxxxx.xx/xxxxx/xxx unless Partner has a written master service agreement executed by Builder for such Services as referenced in the Documentation, in which case such written master subscription agreement between the parties will govern (as applicable, the “MSA”).

The rights granted to you in this Agreement are subject to the following restrictions: (a) you shall not license, sell, rent, lease, transfer, assign, reproduce, distribute, host or otherwise commercially exploit Services or any portion of Services; (b) you shall not frame or utilize framing techniques to enclose any trademark, logo, or other Services (including images, text, page layout or form); (c) you shall not use any metatags or other “hidden text” using Plural’s name or trademarks; (d) you shall not modify, translate, adapt, merge, make derivative works of, disassemble, decompile, reverse compile or reverse engineer any part of Services except to the extent the foregoing restrictions are expressly prohibited by applicable law; (e) you shall not use any manual or automated software, devices or other processes (including but not limited to spiders, robots, scrapers, crawlers, avatars, data mining tools or the like) to “scrape” or download data from the Services; (f) you shall not access Services in order to build similar or competitive products or services; (g) except as expressly stated herein, no part of Services may be copied, reproduced, distributed, republished, downloaded, displayed, posted or transmitted in any form or by any means; (h) you shall not remove or destroy any copyright notices or other proprietary markings contained on or in Services;
Restrictions on Use of the Services. MASC Executive’s JourneyCall users provide their real names and information, with our intentions to keep the same secure as described in this agreement, and we need your help to keep it that way. Here are some undertakings and commitments you make to us relating to registering and maintaining the security of your account, and upon which we are relying as representations in entering into this agreement: You will not provide any false personal information on MASC Executive’s JourneyCall, or create an account for anyone other than yourself without permission; You will not create more than one personal profile; If we disable your account, you will not create another one without our permission; You will not use your personal profile for your own commercial gain; You will keep your third party contact information and Content accurate and up to date; You will not share your password, let anyone else access your account, or do anything else that might jeopardize the security of your account; You will not transfer your account to anyone. Protecting other peoples’ rights We respect other peoples’ rights, and expect you to do the same. You will not upload content or take any action on MASC Executive’s JourneyCall that infringes or violates someone else's rights or otherwise violates the law. We can remove any content or information you post on MASC Executive’s JourneyCall if we believe that it violates this Statement. You will not use our copyrights or trademarks, or any confusingly similar marks, without our written permission.
