Restoration of Leave. If extension of a furlough period or other reason will cause an employee to lose annual leave that had been previously scheduled and approved, Management will take action to allow the employee to take leave after the furlough period(s) or restore the leave under PL 93- 181, if appropriate.

Restoration of Leave a. The Chancellor or the Chancellor’s designee is responsible for notifying the membership of, and providing the required form(s) for, the process to be followed in the restoration of annual leave in accordance with the annualuse or loseleave protocol.
Restoration of Leave. Most employees can carry a maximum of 240 hours of annual leave from one leave year to the next. “Use or lose” annual leave is the accrued annual leave above the maximum carry over amount. Employees must use their excess annual leave by the end of the leave year or they will “lose” (forfeit) it. In some cases, an employee may be able to get the lost leave restored, but only if it was forfeited because of: • An exigency of the public business • The employee’s sickness • An administrative error The employee must have had the annual leave scheduled for use in writing before the start of the third biweekly pay period prior to the end of the leave year. For leave purposes, a leave year begins on the first day of the first full biweekly pay period in a calendar year. A leave year ends on the day immediately before the first day of the first full biweekly pay period in the following calendar year. When “use or lose” leave has been approved by the supervisor and is subsequently canceled by management prior to the employee actually taking the leave, the employee will be advised of the cancellation and the reason for such cancellation in writing per regulation. The excess annual leave will then be considered for restoration in accordance with applicable rules and regulations.
Restoration of Leave. When “use or lose” leave has been approved using an OPM Form 71 and is subsequently canceled by management prior to the employee actually taking the leave, the employee will be advised of the cancellation and the reason for such cancellation in writing per regulation. The excess annual leave will then be restored in accordance with applicable rules and regulations.

  • Duration of Leave An eligible female employee may apply for pregnancy leave, to commence after the 22nd week of pregnancy for a duration of up to 17 weeks. The pregnancy leave of an employee who is not entitled to take parental leave ends on the later of the day that is seventeen weeks after the pregnancy leave began or the day that is six weeks after the birth, still-birth or miscarriage.

  • Termination of Leave Interruption of pregnancy will terminate the leave. Human Resources may require in such cases forty-five (45) days notice to return.

  • Accumulation of Leave ESL is cumulative to a maximum of thirty (30) working days (240 hours), after which time no additional leave may be earned until the leave balance is reduced through use of leave hours. An employee cannot have more than 240 hours of ESL credit in the bank at any time. The maximum ESL balance shall be pro-rated for employees who regularly work less than forty (40) hours per week.

  • Expiration of Leave Except as otherwise provided in this Article, twenty (20) days before the expiration of a leave for ninety (90) days or more, or five (5) days before expiration of a leave for twenty (20) days but less than ninety (90) days, the employee should make every effort to notify the Personnel Office of his/her intention to return, or request an extension of leave, if eligible. Unless such notice is given, failure to return to work upon expiration of the leave may be considered resignation from service.

  • Extension of Leaves Employees who are entitled to leave pursuant to Articles 20.1 and 20.2 shall be entitled to an extended leave of up to an additional six (6) months for health reasons where a doctor's certificate is presented. Such written request must be received by the Employer at least four weeks prior to the expiration of leave taken pursuant to Article 20.1 and 20.2.

  • Extension of Leave 4 If an extension of the leave is required, a request for the extension must be 5 submitted on the Leave Request Form at least five days in advance of the leave 6 expiration. Consideration of an extension will be based on the same criteria as 7 the original request. Failure to return to work at the expiration of the leave may 8 result in termination.

  • Restoration of Vacation Leave In the event an employee is injured or becomes ill while on vacation leave, the employee may submit a written request to use sick leave and have the equivalent amount of vacation leave restored. The supervisor may require a written medical certificate.

  • Verification of Leave Upon return from leave the employee will provide the necessary claim form for verification of absence to his/her principal/supervisor within five (5) workdays in accordance with §1012.61, Florida Statutes.

  • Termination of Lease Landlord may terminate Tenant’s interest under the Lease, but no act by Landlord other than notice of termination from Landlord to Tenant shall terminate this Lease. The Lease shall terminate on the date specified in the notice of termination. Upon termination of this Lease, Tenant will remain liable to Landlord for damages in an amount equal to the rent and other sums that would have been owing by Tenant under this Lease for the balance of the Lease term, less the net proceeds, if any, of any re-letting of the Premises by Landlord subsequent to the termination, after deducting all of Landlord’s Reletting Expenses (as defined below). Landlord shall be entitled to either collect damages from Tenant monthly on the days on which rent or other amounts would have been payable under the Lease, or alternatively, Landlord may accelerate Tenant’s obligations under the Lease and recover from Tenant: (i) unpaid rent which had been earned at the time of termination; (ii) the amount by which the unpaid rent which would have been earned after termination until the time of award exceeds the amount of rent loss that Tenant proves could reasonably have been avoided; (iii) the amount by which the unpaid rent for the balance of the term of the Lease after the time of award exceeds the amount of rent loss that Tenant proves could reasonably be avoided (discounting such amount by the discount rate of the Federal Reserve Bank of San Francisco at the time of the award, plus 1%); and (iv) any other amount necessary to compensate Landlord for all the detriment proximately caused by Tenant’s failure to perform its obligations under the Lease, or which in the ordinary course would be likely to result from the Event of Default, including without limitation Reletting Expenses described below.

  • Commencement of Leave Parental leave must commence no later than the first anniversary date of the birth or adoption of the child or of the date on which the child comes into the actual care and custody of the employee. The employee will decide when his or her parental leave is to commence.
