Common use of Rest Between Shifts Clause in Contracts

Rest Between Shifts. Unless performing standby duty, each nurse, except those who have agreed to work and are working twelve (12) hour regularly scheduled shifts, shall have an unbroken rest period of at least twelve (12) hours between shifts. Each nurse who has agreed to work and is working a regularly scheduled twelve (12) hour shift shall have an unbroken rest period of at least ten (10) hours between shifts. Any time worked without the required rest shall be paid at the premium rate of time and one-half the regular rate of pay.

Any time worked without the required rest shall be paid at the premium rate of time one and one-half (1-1 /2) their base hourly rate. A Nurse may waive this provision through a written waiver on file at the regular rate Nursing Administration Office. Overtime or standby pay shall count as rest period for the purpose of payparagraph one (1) above.
