Responsibility for Agents and Contractors. At all times and during both the Preconstruction and Construction Phases, the Contractor shall be responsible to the Department for any and all acts and omissions of the Contractor’s agents, employees, Subcontractors, Sub-Subcontractors, material suppliers, and laborers, and the agents and employees of the Subcontractors, Sub-Subcontractors, material suppliers, and laborers performing or supplying Work in connection with the Project.

Responsibility for Agents and Contractors. At all times and during both the Preconstruction and Construction Phases, the Construction Manager shall be responsible to the Department, the Program Manager and the Architect/Engineer for any and all acts and omissions of the Construction Manager’s agents, employees, Subcontractors, Sub- Subcontractors, material suppliers, and laborers, and the agents and employees of the Subcontractors, Sub-Subcontractors, material suppliers, and laborers performing or supplying Work in connection with the Project. This Section 1.6 shall apply during both the Preconstruction and Construction Phases.

CONSTRUCTION MANAGER’S PRECONSTRUCTION SERVICES Preconstruction Services. The Preconstruction Phase will start from the issuance of the notice to proceed through the execution of this Agreement. The Department will issue a notice to proceed for preconstruction services (the “Letter Contract”). During the Preconstruction Phase, the Construction Manager shall provide such preconstruction services as are necessary to properly advance the Project. Without limiting the generality of the foregoing, during the Preconstruction Phase, the Construction Manager shall: (i) work with the Department’s Architect and any design consultants to provide constructability reviews of the design for the Project in consultation with Client Agency, the Department and its Program Manager; (ii) engage in any value engineering and scoping exercises requested by the Department; and (iii) engage in preconstruction activities, including identifying any long-lead items. Throughout the Preconstruction Phase, the Construction Manager shall schedule and attend regular meetings with the Department, the Program Manager and the Architect. A list of preconstruction deliverables is set forth in Exhibit C.

  • Responsibilities of Contractor A. The Contractor shall perform all work on the described project as required by the Contract documents. The work to be performed includes the labor and services necessary to produce such replacement, and all materials, supplies, tools, transportation, equipment, and machinery required for replacement.

  • Contractor’s Responsibilities Unless stated specifically to the contrary in the tender with full supporting explanations, the contractor will be deemed to have concurred as a practical manufacturer with the design and layout of the works as being sufficient to ensure reliability and safety in operation, freedom from undue stresses and satisfactory performance in all other essentials as a working material.

  • CONTRACTOR'S RESPONSIBILITY Nothing herein shall be construed as limiting in any way the extent to which contractor/renter may be held responsible for damages resulting from contractor/renter’s operations, acts, omissions or negligence. Insurance coverage obtained in the minimum amounts specified above shall not relieve contractor/renter of liability in excess of such minimum coverage, nor shall it preclude the fair from taking other actions available to it under contract documents or by law, including, but not limited to, actions pursuant to contractor/renter’s indemnity obligations. The contractor/renter indemnity obligations shall survive the expiration, termination or assignment of this contract.

  • ARCHITECT’S RESPONSIBILITIES § 2.1 The Architect shall provide professional services as set forth in this Agreement. The Architect represents that it is properly licensed in the jurisdiction where the Project is located to provide the services required by this Agreement, or shall cause such services to be performed by appropriately licensed design professionals.
