Responsibility Determination. The Government will only evaluate the plan submitted by the apparently successful offeror. The evaluation will be performed by the Small Business Specialist and the Contract Specialist. The Government reserves the right pursuant to FAR 9.105-1(c)(3) and 19.705-3 to confer with the offeror on elements of the Small Business Subcontracting Plan in order to determine Responsibility prior to award. These conversations will not constitute discussions as defined in FAR 15.306(c). The Small Business Subcontracting Plan shall be provided concurrent with submission of the Offeror’s proposal and will be incorporated into the task order. The individual plan shall contain the following:
Responsibility Determination. 8.1 Vendor represents and warrants that any information submitted as part of NYC Health + Hospitals’ vendor responsibility determination process, including PASSPort, have been, or will be, fully answered in accordance with the requirements set forth by the New York City Mayor’s Office of Contract Services. The veracity of the information submitted is a material inducement to NYC Health + Hospitals’ execution of this Agreement.
Responsibility Determination. Responsibility will be determined by analyzing whether the apparent successful offeror complies with the requirements of FAR 9.1, including:  adequate financial resources or the ability to obtain them;  ability to comply with the required performance period, taking into consideration all existing commercial and governmental business commitments;  satisfactory record of integrity and business ethics;  necessary organization, experience, and skills or the ability to obtain them;  necessary equipment and facilities or the ability to obtain them; and  be otherwise qualified and eligible to receive an award under applicable laws and regulations.
Responsibility Determination. If the mandatory small business subcontracting goal of 5% is not met, the Offeror may be determined ineligible for award based on initial proposals. Offers from Small Business concerns must demonstrate that no single subcontractor will perform more than the Small Business Prime. Unlike small business set-asides which require the small business prime to perform at least 50% of the proposed effort, this solicitation is not reserved for small business and therefore the 50% rule does not apply, however no subcontractor can perform a greater amount of the effort than the prime. OTHER: Responsibility: Offerors must meet the standard for FAR 9.104. A determination of non-responsibility for a small business concern shall be referred by the contracting officer to the Small Business Administration, which will decide whether to issue a Certificate of Competency. An Offeror that will be unable to comply with the limitations on subcontracting under FAR 52.219-14 may be considered non-responsible. A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful Offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award. Responsibility Determination. Based on the scope size, complexity and potential risk to AHA, the following processes will be followed to determine and document Respondent responsibility. Respondents who after proposal evaluation make the competitive range may be asked to submit additional information. Failure by the Respondent to provide such additional information within the allotted time may render the Respondent ineligible for award. AHA shall make an assessment of the Respondent’s responsibility, that is, whether in the opinion of AHA the Respondent is capable of undertaking and completing the RFP scope of work delineated within this RFP in a satisfactory manner. AHA will award a contract only to responsible Respondent’s that have the ability to successfully perform under the terms of this RFP. AHA’s determination includes an assessment of the Respondent’s technical resources/ability to perform the scope of work in accordance with the RFP requirements. The responsibility determination also includes consideration of a Respondent’s integrity, compliance with public policy, past performance with AHA (if any), and eligibility to perform government work (e.g., debarment/suspension from any Federal, State, or local government).

Responsibility Determination. To assist in determining contractor responsibility in accordance with FAR Part 9.104, the Offeror shall explain how they plan to maintain adequate financial resources for a contract of this magnitude and length. Address fiscal plan for covering mobilization, unexpected or emergency situations, and initial performance costs prior to recoupment in the form of monthly invoice payments. Offeror’s must provide complete financial statements for one fiscal year and year-to-date financial information through the last quarter available. The year- end financial statements must be certified by an independent accounting firm, if practicable, or at least by an authorized officer of the organization. If the Offeror intends to rely on internally available working/operation capital, evidence of availability must be submitted. If the Offeror plans to rely on financial support from other sources, evidence of availability and the maximum lines of credit available must be identified and must be based upon the inclusion of this contract effort. Evidence of external funding must be provided in the form of a dated letter from the external source. Documentation to support the amounts must also be included.
