(a) It is the intent of the parties to bind the Union and all local and international officers and representatives of the Union, and all employees as defined in Article 2 hereof, and the City, its officers and representatives to observe and adhere to the terms of this contract.

Echoing the previous chapter, some might argue that there is no continuity between Xxxxx’s duty not to attend at t1 and her normative position at t2 because there is wrongful, intervening agency by Xxxxxx himself. In other words, Xxxxxx’s intervening agency stops Xxxxx’s initial disrespect of her duty from resulting in increased stringency at t2. The response fails because it does not take into account that when we say that Xxxxx has a duty at t1 not to go and harm Xxxxxx at t2, we are already factoring in Xxxxxx’s intervening agency. The duty is grounded in the inherent value of his interests regardless of his wrongful intervening agency. Thus, I do not think that merely pointing to his wrongful and primary role in creating the need for defensive harm suffices to explain why her duty should not exist and be more stringent at t2. The situation between Xxxxx and Xxxxxx with respect to the value of Xxxxxx’s life is sim- ilar to the relationship between a primary duty bearer and someone required to pick up the slack due to the primary’s unwillingness to comply with their duty. Xxxxxxx A is primarily respon- sible for saving his daughter from drowning but refuses. To save her, B now has to make a sacrifice. Although it is unfair to demand this of B, it seems plausible that he can be required to sacrifice, at least if the cost is not higher than what he could have been required to sacrifice if he was in fact the only one able to save her.27 Xxxxxxx now that also B refuses. The longer he refuses, the more he has to sacrifice to save the child. In my view, his refusal to do what is required of him can increase the stringency of his duty here as well, even if A is the one with the primary responsibility for saving her.

Responsibility and Rights. 2.1 If the car is damaged or for some other reason can’t be available for the rentee, for example, Consensus needs the car in emergency case or on short notice, shall Consensus contact the rentee as soon as possible. Consensus has no responsibility for replacing the vehicle and the booking is deleted.
