Such services shall include: asbestos and lead paint survey; abatement documentation; and specifications related to said matters which are to be incorporated into bid documents prepared by ARCHITECT. The ARCHITECT shall be entitled to rely upon the accuracy and completeness of services, information, surveys, and reports provided or furnished by the DISTRICT. The ARCHITECT shall advise the DISTRICT if it becomes aware of any error or deficiency in said services, information, surveys, and reports. The DISTRICT shall, in writing, advise the ARCHITECT if the DISTRICT becomes aware of any fault or defect in the Project, including any errors, omissions or inconsistencies in the ARCHITECT’S documents. Failure to provide such notice shall not relieve ARCHITECT of its responsibility therefore, if any. If required for the ARCHITECT’S services and so advised by the ARCHITECT, the DISTRICT shall furnish surveys to describe physical characteristics, legal limitations and utility locations for the Project site(s), and a written legal description of the Project site(s). The surveys and legal information shall include, as applicable, grades and lines of streets, alleys, pavements and adjoining property and structures; adjacent drainage; rights-of-way, restrictions, easements, encroachments, zoning, deed restrictions, boundaries and contours of the Project site(s); locations, dimensions and necessary data with respect to existing buildings, other improvements and trees; and information concerning available utility services and lines, both public and private, above and below grade, including inverts and depths. All the information on the survey shall be referenced to a Project benchmark for each Project site. If so advised by the ARCHITECT and unless otherwise provided in this Agreement, the DISTRICT shall furnish tests, inspections and reports required by law or the Contract Documents, such as structural, mechanical, and chemical tests, tests for air and water pollution, and hazardous materials.
