Ensure the funds subject to this Agreement are used in accordance with conditions, requirements, budget, timetable and restrictions of federal, state, and local laws, as well as the federal terms and conditions of the Prime Award and this Subaward; • Utilize funds subject to this Agreement to supplement rather than supplant funds otherwise available; • Comply with all financial reporting requirements of CCG and federal government related to the use of funds subject to this Agreement; • Promptly reimburse CCG for any funds CCG pays to any entity because of an adverse audit finding, adverse quality control finding, final disallowance of federal financial participation, or other sanction or penalty for which CCG is responsible regarding American Rescue Plan Act funds; • Take prompt corrective action, including paying amounts resulting from an adverse finding, sanction, or penalty, if CCG, or any state or Federal auditor, agency or other entity authorized by federal, state, or local law determines compliance with conditions, requirements, and restrictions applicable to the federal program from which this subgrant is awarded has not been achieved; • Make records and personnel available to CCG, or any state or Federal auditor, agency or other entity authorized by federal, state, or local law to perform reviews, audits, or investigations in relation to the funds subject to this Agreement; • Comply with all terms and conditions contained in this Agreement.

RESPONSIBILITIES OF SUBRECIPIENT. Subrecipient’s responsibilities under this Agreement include but are not limited to the following: Subrecipient is responsible for funding costs of design of the infrastructure improvements and such costs will be reimbursable. Subrecipient is responsible for construction of the improvements. Subrecipient will own the improvements and be responsible for future maintenance and repair. Subrecipient will be responsible for funding any project costs in excess of the sum set forth in paragraph 3 of this Agreement. If Subrecipient does not enter into a contract for construction of any individual project improvement by December 31, 2024, Subrecipient shall not be entitled to funding for any costs associated with the project. In such an event, Subrecipient shall have no obligation to proceed with construction of the improvement. Any costs funded by Subrecipient after December 31, 2026 shall not be eligible for reimbursement under this Agreement.
