Common use of Resignation and Appointment of Successor Clause in Contracts

Resignation and Appointment of Successor. (a) The Company agrees, for the benefit of the holders from time to time of the Warrants, that there shall at all times be a Warrant Agent hereunder until all the Warrants are no longer outstanding or until monies for the payment of all outstanding Warrants, if any, shall have been paid to the Warrant Agent and shall have been returned to the Company as provided in Section 2.6, whichever occurs earlier.

(a) The Company agrees, for the benefit of the holders from time to time of the Warrants, that there shall at all times be a Warrant Agent hereunder with respect to each series of Warrants until all the Warrants of such series are no longer outstanding or until monies for the payment of all outstanding WarrantsWarrants of such series, if any, shall have been paid to the Warrant Agent and shall have been returned to the Company as provided in Section 2.62.02, whichever occurs earlier.
