Required Contract Provisions. Private service provider contracts paid in whole or part with grant funds shall include the following provisions in the contract between the Grantee and the service provider:

The parties agree, and the SPONSOR shall also provide in its contracts for the Project, that all design, plans, specifications, estimates of costs, construction, utility relocation work, right-of-way acquisition procedures, acceptance of the work and procedures in general shall, at all times, conform to all applicable federal and state laws, rules, regulations, orders and approvals, including specifically the procedures and requirements relating to labor standards, equal employment opportunity, nondiscrimination, anti-solicitation, information, auditing and reporting provisions. Contractor understands and acknowledges that the Part 200 Uniform Requirements require that non-Federal entities’ contracts contain the applicable provisions described in Appendix II to Part 200 – “Contract Provisions for Non-Federal Entity Contracts Under Federal Awards.” Contractor further understands and acknowledges that violations of law will be referred to the proper authority in the applicable jurisdiction. All Prime Contractors awarded contracts by Fort Bend County which are federally funded, in whole or in part, are required to comply with the provisions in Exhibit B attached, and included by reference. In addition, Contractor understands and acknowledges that a prime Contractor with Fort Bend County is required to include the provisions in Exhibit B, in any contracts executed with subcontractors performing the scope of work and shall pass these requirement on to is subcontractors and third-party contractors, as applicable.
