Request for Transfer. Unless the paraeducator and both principals agree, no transfers shall be allowed during a period spanning from 14 calendar days before the first contract work day until after the 20th contract work day. A transfer will not be considered unless the paraeducator is qualified for such vacancy. All transfers shall be initiated by the receiving principal, with copies to the releasing principal or immediate supervisor and the Human Resource Services office. The principal, when making his/her decision, shall consider the following: seniority, educational qualifications, expertise and ability, prior job experience, performance evaluations, and recommendations of previous supervisors. The transfer of the paraeducator will be subject to Board approval.

Lessee shall give Lessor at least thirty (30) days prior written notice of any desired Transfer and of the proposed terms of such Transfer, including but not limited to: the name and legal composition of the proposed Transferee; an audited financial statement of the proposed Transferee prepared in accordance with generally accepted accounting principles within one year prior to the proposed effective date of the Transfer; the nature of the proposed Transferee's business to be carried on in the Premises; the payment to be made or other consideration to be given on account of the Transfer; and other such pertinent information as may be requested by Lessor, all in sufficient detail to enable Lessor to evaluate the proposed Transfer and the prospective Transferee. Lessee's notice shall not be deemed to have been served or given until such time as Lessee has provided Lessor with all information specified above and all additional information requested by Lessor pursuant to this subsection 13.d. Lessee shall immediately notify Lessor of any modification to the proposed terms of such Transfer.
Request for Transfer. Annually, a nurse may make a written request for a transfer by advising the Employer and filing a Request for Transfer form provided by the Human Resources Department indicating name, qualifications, experience, present area of assignment, seniority and requested area of assignment/hours of work. A Request For Transfer shall become active as of the date it is received by the Employer and shall remain in effect until December 31st of each year. Such requests will be considered as applications for posted vacancies and subsequent vacancies created by the filling out of a posted vacancy.

Lessee’s notice shall not be deemed to have been served or given until such time as Lessee has provided Lessor with all information specified above and all additional information requested by Lessor pursuant to this Article 13d. Lessee shall immediately notify Lessor of any modification to the proposed terms of such Transfer. Provided the following recapture right shall not apply to Permitted Transfers, notwithstanding any other provision to the contrary in this Lease, upon receipt of any notice from Lessee requesting any Transfer pursuant to this Article, Lessor shall have the right and option, by written notice to Lessee (a “Recapture Notice”) given on or before the date which is thirty (30) days after Lessor’s receipt of such notice, to recapture the Premises, in which case this Lease shall terminate on the date which is thirty (30) days after Lessee’s receipt of a Recapture Notice. Upon any such termination of this Lease, the parties shall be relieved of all further obligations under this Lease, except for any liability theretofore accrued and those obligations which survive the termination of this Lease pursuant to any provision hereof.

Request for Transfer. The parties agree that the following language will supersede any and all divisional or Corporate transfer policies.
Request for Transfer for the Following School Year: A request for transfer shall be provided to the Human Resource Services Division via the Staff Portal any time after the first day of the second semester through the last day of the current regular school year. These requests are for the following school year. Such transfer requests shall remain active until 14 calendar days before the first teacher contract day. Transfers shall not occur after the beginning of the school year. An employee seeking a transfer must complete the online application (Applicant Registration System) and apply for posted vacancies. Any teacher who received an end of the year overall evaluation of Needs Improvement for the current and/or previous school year is not eligible for transfer. Also, any teacher who is under a Performance Development Plan is ineligible for transfer. A transfer will not be considered unless the teacher has taught in the District for one school year and is fully qualified and certified for the vacancy for which they are applying. It is the responsibility of the teacher to notify the principals where vacancies exist in order to be considered for the vacancy. The transfer will be subject to approval by the District Certification Compliance Department. All transfers shall be approved and signed by the receiving principal, with simultaneous electronic copies to the releasing principal (or immediate supervisor) and the Human Resource Services office. The receiving principal, when making his/her decision, shall consider each teacher requesting transfer as to his/her experience, general background and preparation, competence and commuting distance.
