Request for Extension of Credit. The Applicable Agent and, if applicable, the applicable Issuing Bank or the Swingline Bank, shall have received a Notice of Loan Borrowing, a Notice of Swingline Loan Borrowing or a Letter of Credit Application, as applicable, in accordance with the requirements hereof. Each request for an Extension of Credit and each acceptance by a Borrower of an Extension of Credit shall be deemed to constitute a representation and warranty by the Borrower Representative and the Borrowers as of the date of such Extension of Credit that the applicable conditions in paragraphs (a) and (b) of this Section 5.2 have been satisfied.

  • Request for Extension Upon request, the Department may extend the time allowed for both a response to the Letter of Concern and a Corrective Action Plan depending upon the nature of the deficiency. The Provider shall request an extension of time in writing from the Department’s designated representative. The written request shall contain a justification and proposed extension period.

  • Request for Credit Extension The Administrative Agent and, if applicable, the L/C Issuer or the Swingline Lender shall have received a Request for Credit Extension in accordance with the requirements hereof. Each Request for Credit Extension submitted by the Borrower shall be deemed to be a representation and warranty that the conditions specified in Sections 4.02(a) and (b) have been satisfied on and as of the date of the applicable Credit Extension.

  • Conditions to Initial Extension of Credit The agreement of each Lender to make the initial extension of credit requested to be made by it is subject to the satisfaction, prior to or concurrently with the making of such extension of credit on the Closing Date, of the following conditions precedent:
