Common use of Replacement of Warrant Clause in Contracts

Replacement of Warrant. On receipt of evidence reasonably satisfactory to the Company of the loss, theft, destruction or mutilation of this Warrant and, in the case of loss, theft or destruction, on delivery of an indemnity agreement reasonably satisfactory in form, substance and amount to the Company or, in the case of mutilation, on surrender of this Warrant to the Company for cancellation, the Company shall, within a reasonable time, execute and deliver to Holder, in lieu of this Warrant, a new warrant of like tenor and amount.

Replacement of Warrant. On receipt of evidence reasonably satisfactory to the Company of the loss, theft, destruction or mutilation of this Warrant and, in the case of any such loss, theft or destructiondestruction of this Warrant, on delivery of an indemnity agreement or security reasonably satisfactory in form, substance form and amount to the Company or, in the case of any such mutilation, on surrender of this Warrant to the Company for cancellation, the Company shall, within a reasonable time, execute and deliver to Holder, in lieu cancellation of this Warrant, the Company at its expense, twice only, will execute and deliver, in lieu thereof, a new warrant Warrant of like tenor and amounttenor.

On Upon receipt of evidence reasonably satisfactory to the Company of the loss, theft, destruction or mutilation of this Warrant and, in the case of any such loss, theft or destruction, on upon delivery of an indemnity agreement reasonably satisfactory in form, substance and amount to the Company Company, or, in the case of any such mutilation, on upon surrender and cancellation of this Warrant to the Company for cancellationsuch Warrant, the Company shall, within a reasonable time, at its expense will execute and deliver to Holderdeliver, in lieu of this Warrantthereof, a new warrant Warrant of like tenor and amounttenor.

Replacement of Warrant. On Upon receipt of evidence reasonably satisfactory to the Company of the loss, theft, destruction or mutilation of this Warrant andWarrant, and upon receipt of written indemnification of the Company by the Holder in the case of loss, theft or destruction, on delivery of an indemnity agreement form and substance reasonably satisfactory in form, substance and amount to the Company or, in the case of mutilation, on surrender of this Warrant to the Company for cancellationCompany, the Company shall, within a reasonable time, shall execute and deliver to Holder, in lieu of this Warrant, the Holder a new warrant Warrant of like date, tenor and amountdenomination.

Replacement of Warrant. On receipt of evidence reasonably satisfactory to the Company of the loss, theft, destruction destruction, or mutilation of this Warrant and, in the case of any such loss, theft theft, or destructiondestruction of this Warrant, on delivery of an indemnity agreement or security reasonably satisfactory in form, substance form and amount to the Company or, in the case of any such mutilation, on surrender of this Warrant to the Company for cancellation, the Company shall, within a reasonable time, execute and deliver to Holder, in lieu cancellation of this Warrant, the Company at its expense, twice only, will execute and deliver, in lieu thereof, a new warrant Warrant of like tenor and amounttenor.

Replacement of Warrant. On receipt of evidence reasonably satisfactory to the Company of the loss, theft, destruction or mutilation of this Warrant and, in the case of any such loss, theft or destructiondestruction of this Warrant, on delivery of an indemnity agreement reasonably satisfactory in form, substance and amount mutually agreeable to the Company and the Holder or, in the case of any such mutilation, on surrender and cancellation of this Warrant to the Company for cancellationsuch Warrant, the Company shall, within a reasonable time, at its expense will execute and deliver to Holderdeliver, in lieu of this Warrantthereof, a new warrant of like tenor and amountsubstantially identical warrant.

Replacement of Warrant. On Upon receipt of evidence reasonably satisfactory to the Company of the loss, theft, destruction or mutilation of this Warrant and, and (in the case of loss, theft or destruction, on ) upon delivery of an indemnity agreement (with surety if reasonably required) in an amount reasonably satisfactory in form, substance and amount to the Company orCompany, or (in the case of mutilation, on ) upon surrender of this Warrant to the Company for cancellation, the Company shall, within a reasonable time, execute and deliver to Holder, in lieu cancellation of this Warrant, the Company will issue, in lieu thereof, a new warrant Warrant of like tenor and amounttenor.

On receipt of evidence reasonably satisfactory to the Company of the loss, theft, destruction or mutilation of this Warrant and, in the case of any such loss, theft or destructiondestruction of this Warrant, on delivery of an indemnity agreement or security reasonably satisfactory in form, substance form and amount to the Company or, in the case of any such mutilation, on surrender of this Warrant to the Company for cancellation, the Company shall, within a reasonable time, execute and deliver to Holder, in lieu cancellation of this Warrant, the Company at the Holder's expense, twice only, will execute and deliver, in lieu thereof, a new warrant Warrant of like tenor and amounttenor.

On Upon receipt of evidence reasonably satisfactory to the Company of the loss, theft, destruction or mutilation of this Warrant and, in the case of any such loss, theft or destruction, on upon delivery of an indemnity agreement and bond reasonably satisfactory in form, substance form and amount to the Company Company, or, in the case of any such mutilation, on upon surrender of this Warrant to the Company for cancellation, the Company shall, within a reasonable time, execute and deliver to Holder, in lieu cancellation of this Warrant, Company, at its expense, shall execute and deliver, in lieu thereof, a new warrant Warrant of like tenor and amounttenor.

On Upon receipt of evidence reasonably satisfactory to the Company of the loss, theft, destruction destruction, or mutilation of this Warrant andor, in the case of any such loss, theft theft, or destruction, on delivery upon delivery, of an indemnity agreement reasonably satisfactory in form, substance form and amount to the Company Company, or, in the case of any such mutilation, on upon surrender of this Warrant to the Company for cancellation, the Company shall, within a reasonable time, execute and deliver to Holder, in lieu cancellation of this Warrant, the Company, at its expense, will execute and deliver, in lieu thereof, a new warrant of like tenor and amountWarrants, in the form hereof, in such denominations as Holder may request.

Replacement of Warrant. On receipt of evidence reasonably satisfactory to the Company of the loss, theft, destruction or mutilation of this Warrant and, in the case of loss, theft or destruction, on delivery of an indemnity agreement reasonably satisfactory in form, substance and amount to the Company or, in the case of mutilation, on surrender and cancellation of this Warrant to the Company for cancellationWarrant, the Company at its expense shall, within a reasonable time, execute and deliver to Holder, in lieu of this Warrant, a new warrant of like tenor and amounttenor.

Replacement of Warrant. On Upon receipt by the Company of (i) evidence reasonably satisfactory to the Company it of the loss, theft, destruction or mutilation of this Warrant Warrant, and, in the case of such loss, theft theft, destruction or destructionmutilation, on delivery of and (ii) an indemnity agreement or other security reasonably satisfactory to it in formits sole discretion, substance and amount upon reimbursement to the Company orof all expenses incidental or relating thereto, and in the case event of mutilation, on mutilation upon surrender and cancellation of this Warrant to the Company for cancellationWarrant, the Company shall, within a reasonable time, execute will make and deliver to Holdera new Warrant of like tenor, in lieu of this Warrant, a new warrant of like tenor and amount.

On Upon receipt of evidence reasonably satisfactory to the Company of the loss, theft, destruction destruction, or mutilation of this Warrant and, in the case of lossany such logs, theft theft, or destruction, on upon delivery of an indemnity agreement reasonably satisfactory in form, substance form and amount to the Company Company, or, in the case of any such mutilation, on upon surrender of this Warrant to the Company for cancellation, the Company shall, within a reasonable time, execute and deliver to Holder, in lieu cancellation of this Warrant, the Company, at its expense, will execute and deliver, in lieu thereof, a new warrant Warrant of like tenor and amounttenor.

Replacement of Warrant. On Upon receipt of evidence reasonably satisfactory to the Company of the loss, theft, destruction destruction, or mutilation of this Warrant and, in the case of any such loss, theft theft, or destructiondestruc­tion, on upon delivery of an indemnity agreement reasonably satisfactory in form, substance form and amount to the Company Company, or, in the case of any such mutilation, on upon surrender of this Warrant to the Company for cancellation, the Company shall, within a reasonable time, execute and deliver to Holder, in lieu cancellation of this Warrant, the Company, at its expense, will execute and deliver, in lieu thereof, a new warrant Warrant of like tenor and amounttenor.

Replacement of Warrant. On receipt of evidence reasonably satisfactory to the Company of the loss, theft, destruction or mutilation of this Warrant and, in the case of loss, theft or destruction, on delivery of an indemnity agreement agreement, with surety if reasonably required, in an amount reasonably satisfactory in form, substance and amount to the Company orCompany, or in the case of mutilation, on surrender and cancellation of this Warrant to the Company for cancellationWarrant, the Company shall, within a reasonable time, at its expense shall execute and deliver to Holderdeliver, in lieu of this Warrant, a new warrant of like tenor and amount.

Replacement of Warrant.
