Renewal Notice; Notification of Changes. Subject to governing law, XOOM can renew this Agreement with new or revised Terms. XOOM will send you written notice at least (30) days before the end of the Term. The notice will specify the date by which you must advise XOOM if you do not want to renew your Agreement. If you do not advise XOOM by the specified date, this Agreement will automatically renew at the fixed rate or variable rate then in effect in accordance with the notice. XOOM reserves the right, with fifteen (15) days’ notice, to amend this Agreement to adjust its service to accommodate any change in regulations, law, tariff or other change in procedure required by any third party that may affect XOOM’s ability to continue to serve you under this Agreement.

No later than forty-five (45) days prior the end of the term, XOOM will send you renewal notices, at least two, describing additional service plans for your consideration, in the event XOOM elects to renew this Agreement. If you decide not to choose a new service plan upon the expiration of the term, this Agreement will automatically renew at a variable rate that will continue on a month-to-month basis, in accordance with the notices. XOOM reserves the right, with thirty (30) days’ notice, to amend this Agreement to adjust its service to accommodate any change in regulations, law, tariff, other change in procedure required by any third party that may affect XOOM’s ability to continue to serve you under this Agreement, or to make other changes as XOOM sees fit. To the extent XOOM should amend for any reason other than a change in regulations, law, tariff or other change in procedure required by any third party that may affect XOOM’s ability to continue to serve you under this Agreement, you will have the right to cancel this Agreement by providing written notice to XOOM within thirty (30) days of the date of the notices. XOOM will not make material changes to your contract without your consent. Termination, Moving:You may cancel your acceptance of the Agreement with XOOM at any time within seven (7) business days following the postmark date on the utility’s confirmation notice without penalty or cancellation fee by calling or writing your local utility. When moving to an address within your local utility’s service territory, XOOM will make every effort to transfer your service to your new service address when you move to an address within your local utility’s service territory, provided that you notify XOOM within fifteen (15) days of your move. If transfer of service is not successful or you moved to a location outside your local utility’s service territory or within the service territory of your local utility that does not portability of the contract, you may cancel this Agreement at no cost to you. Failure to notify XOOM of your move will be considered a cancellation of this Agreement in accordance with its terms. This contract will automatically terminate if the requested service location is not served by your local utility, you move outside your local utility’s service area or to an area not served by XOOM, or XOOM returns you to your local utility’s sales service.

If you have a fixed duration contract approaching the expiration date, or whenever we propose to change the terms of service, you will receive two separate written notifications. The first notice will be provided approximately 60 to 75 days in advance and the second 45 days in advance of either the expiration date or the effective date of the proposed changes. These notifications will explain your options going forward. If you decide not to choose a new service plan upon the expiration of the term or decide to terminate your agreement with XOOM Energy by contacting XOOM Energy in writing or by phone at the contacts listed herein, this Agreement will automatically renew at the at the fixed rate or variable rate then in effect in accordance with the notices. XOOM Energy reserves the right, with fifteen (15) days’ notice, to amend this Agreement to adjust its service to accommodate any change in regulations, law, tariff or other change in procedure required by any third party that may affect XOOM Energy’s ability to continue to serve you under this Agreement.

The notice will specify the date by which you must advise XOOM if you do not want to renew your Agreement. If you receive a renewal notice but fail to enroll in one of the new service plans described in that notice before the expiration of the 12 month term, this Agreement will automatically renew at the fixed rate or variable rate then in effect in accordance with the notice. XOOM reserves the right, with thirty (30) days’ written notice, to amend this Agreement to adjust its service to accommodate any change in regulations, law, tariff, other change in procedure required by any third party that may affect XOOM’s ability to continue to serve you under this Agreement, or to make other changes as XOOM sees fit. To the extent XOOM should amend for any reason other than a change in regulations, law, tariff, or other change in procedure required by any third party that may affect XOOM’s ability to continue to serve you under this Agreement, you will have the right to cancel this Agreement by providing written notice to XOOM within thirty (30) days of the date you received written notice of the amendment. XOOM shall have the right to terminate this Agreement if the Illinois Commerce Commission (“ICC”) or your local utility decides to end or change the program under which you buy naturl gas.

This Agreement may automatically renew at the fixed price or variable price then in effect as specified in the renewal notice. XOOM Energy reserves the right, with thirty (30) days’ notice, to amend this Agreement to adjust its service to accommodate any change in regulations, law, tariff or other change in procedure required by any third party that may affect XOOM Energy’s ability to continue to serve you under this Agreement.

If Constellation decides to renew this Agreement, then between 30 and 60 days prior to the end of the Term, Constellation will send me a notice detailing the new Fixed Rate Plan and any conditions that will apply for my renewal including a summary of any new or altered terms, through a method selected by me as described on the first page of this Agreement, of the conditions that will apply for my renewal ("Renewal Notice"). My Agreement will automatically renew at the new price set forth in the Renewal Notice unless I notify Constellation otherwise; provided, however, I will have the right to cancel such renewed agreement within the first two billing cycles of the renewed contract without penalty or cancellation fee. Other than at renewal, any material change made by Constellation to this Agreement requires my express consent. Constellation will send me written notice between 30 and 60 days prior to any material changes to this Agreement. If I do not provide my express consent, this Agreement terminates on the meter read date following the otherwise effective date of the material changes.

XOOM reserves the right, with thirty (30) days’ notice, to amend this Agreement to adjust its service to accommodate any change in regulations, law, tariff, other change in procedure required by any third party that may affect XOOM’s ability to continue to serve you under this Agreement, or to make other, except pricing, changes as XOOM sees fit. To the extent XOOM should amend for any reason other than a change in regulations, law, tariff or other change in procedure required by any third party that may affect XOOM’s ability to continue to serve you under this Agreement, you will have the right to cancel this Agreement by providing written notice to XOOM within thirty (30) days of the date of the notice.

If you do not choose a new service plan upon expiration of the term and do not terminate your Agreement, your Agreement will be automatically renewed under one of XOOM’s available fixed rate plans at the price in effect at the time of your renewal. You will not be charged an early termination fee if you terminate such renewal. XOOM reserves the right, with thirty (30) days’ notice, to amend this Agreement to adjust its service to accommodate any change in regulations, law, tariff or other change in procedure required by any third party that may affect XOOM’s ability to continue to serve you under this Agreement.

No later than 30 da ys prior to the end of the Term , Agera Energy will send you a notice of any change to the exis ting term s and conditions that will apply for your renewal. In the event you renew under Agera Energy’s mont hly variable rate, you may cancel at any time without paying a cancellation fee after co mpleting the Term of your initial Ag reement. Agera Energy will also send you written notice at least 30 days prior to making any material changes to this Agreement.
