Remedies on Default. If Lessee defaults under the provisions of this subparagraph 34(C), Selling Lessor shall have the right to annul the provisions of this paragraph 34 by giving Lessee notice of such election, provided that Selling Lessor has first notified Lessee of such default and Lessee has failed to cure the same within ten (10) days after such notice. Upon Selling Lessor's notice of annulment in accordance herewith, the Xxxxxxx Money shall be forfeited and paid to Selling Lessor as liquidated damages, which shall be Selling Lessor's sole and exclusive remedy. Upon Selling Lessor's notice of annulment in accordance herewith, the Xxxxxxx Earnest Money shall be forfeited xxxxxxted and paid to Selling Lessor as liquidated damages, which shall be Selling Lessor's sole and exclusive remedy.
