Common use of Release of Performance Security Clause in Contracts

Release of Performance Security. ‌ The Performance Security shall remain in force and effect for the entire Concession Period. Upon completion of 6 (six) months after end of the Concession Period and thereby, request made by the Concessionaire for release of the Performance Security along with the particulars which establish satisfaction of the requirements laid down in the Concession Agreement, the Concessioning Authority shall release the Performance Security forthwith.

Release of Performance Security. ‌ The Performance Security shall remain in force and effect for throughout the entire period of Concession Period. Upon completion of 6 Agreement and shall be released within 3 (sixthree) months after end the expiry of Concession Period, provided, however, that the Concession Period Performance Security shall not be released and thereby, shall be kept alive by the Concessionaire if the Concessionaire is in breach of this Agreement. Upon request made by the Concessionaire for release of the Performance Security along with the particulars which establish satisfaction of the requirements laid down specified in the Concession Agreementthis Clause 9.3, the Concessioning Authority shall release the Performance Security forthwith.

Upon till completion of 6 (six) months after 60 days from the end of the Concession Period and thereby(Concession Period + 60 days); provided, however, that the Performance Security shall not be released if the Concessionaire is in material default or breach of this Agreement. Upon request made by the Concessionaire for release of the Performance Security along with the particulars which establish satisfaction of the requirements laid down in the Concession Agreementspecified under this Clause 9.3, the Concessioning Authority shall release the Performance Security forthwith..
