Common use of Release of Performance Security Clause in Contracts

Release of Performance Security. (i) The Authority shall return the Performance Security to the Contractor within 60 (sixty) days of the expiry of the Maintenance Period or the Defects Liability Period, whichever is later, under this Agreement. Notwithstanding the aforesaid, the Parties agree that the Authority shall not be obliged to release the Performance Security until all Defects identified during the Defects Liability Period have been rectified.

Release of Performance Security. (i) The Authority shall return release the Performance Security to the Contractor within 60 (sixty) days of the expiry of the Maintenance Defects Liability Period or the extended Defects Liability Period, whichever is lateras the case may be, under this Agreement. Notwithstanding the aforesaid, the Parties agree that the Authority shall not be obliged to release the Performance Security until all Defects identified during the Defects Liability Period or the extended Defects Liability Period, as the case may be, have been rectified.

Release of Performance Security. (i) 7.4.1 The Authority shall return the Performance Security to the Contractor within 60 (sixty) days of the later of the expiry of the Maintenance Period or the Defects Liability Period, whichever is later, Period under this Agreement. Notwithstanding the aforesaid, the Parties agree that the Authority shall not be obliged to release the Performance Security until all Defects identified during the Defects Liability Period have been rectified.

Notwithstanding the aforesaid, the Parties agree that the Authority Employer shall not be obliged to release the Performance Security until all Defects identified during the Defects Liability Period have been rectified.

(i) The Authority Authority/GMDA shall return the Performance Security to the Contractor within 60 (sixty) days of the later of the expiry of the Maintenance Period or the Defects Liability Period, whichever is later, Period under this Agreement. Notwithstanding the aforesaid, the Parties agree that the Authority Authority/GMDA shall not be obliged to release the Performance Security until all Defects identified during the Defects Liability Period have been rectified.

Release of Performance Security. (i) The Authority shall return the Construction Period Performance Security to the Contractor Concessionaire within 60 (sixty) days of the expiry of the Maintenance Period or the Defects Liability Period, whichever is later, Period under this Agreement. Notwithstanding the aforesaid, the Parties agree that the Authority shall not be obliged to release the Construction Period Performance Security until all Defects identified during 30 (thirty) days after the expiry Defects Liability Period. The Operation PeriodPerformance Security shall remain in force and effect till expiry of the Concession Period have been rectified.and shall be released within 30 (thirty) days therefrom. ARTICLE10

Release of Performance Security. Notwithstanding the aforesaid, the Parties agree that the Authority shall not be obliged to release the Construction Period Performance Security until all Defects identified during 30 (thirty) days after the expiry Defects Liability Period. The Operation Period have been rectifiedPerformance Security shall remain in force and effect till expiry of the Concession Period and shall be released within 30 (thirty) days therefrom.
