As Parent/Guardian and as Participant, we agree to exercise reasonable care and good judgment for the duration of the Activity. We agree that it is our responsibility to ask questions about any aspect of the Activity or overall program that has not been explained to our satisfaction. We acknowledge that Xxxxxxxxx has the sole right to remove the Participant from the Activity for failure to comply with any direction, rule, or policy, or to terminate the Activity. ASSUMPTION OF RISKS: Participation in this Activity is completely voluntary. The Activity may include – but is not limited to – the following: • Virtual group conversations • Interactive learning sessions in an online platform As Parent/Guardian and as a Participant, we understand that the Activity involves risks and potential hazards, including but not limited to the risk of data mining, phishing, viruses, malware, data breach of online information, cyberbullying, exploitation, victimization, cyberstalking, online grooming, cyber predators, digital footprint, reputation loss, claimscompliance violations, demands brand hijacking, image replication, and possible causes we hereby elect to participate in the Activity knowing that the Activity may be hazardous to the Participant and/or my or the Participant’s property. I VOLUNTARILY ASSUME FULL RESPONSIBILITY FOR ANY RISKS OF LOSS, PROPERTY DAMAGE, OR PERSONAL INJURY, THAT MAY BE SUSTAINED BY THE PARTICIPANT, OR ANY LOSS OR DAMAGE TO PROPERTY OWNED BY ME AS A RESULT OF THE PARTICIPANT’S PARTICIPATION IN THE ACTIVITY, WHETHER CAUSED BY THE NEGLIGENCE OF RELEASEES OR OTHERWISE. In consideration of and as inducement to, Swan Cycle Park, Inc. permitting my child (the rider) to participate in a motorsports activities on the property of Swan Cycle Park, Inc., I for myself, my spouse (if married), my heirs, personal representatives and assigns to waive and release any and all damages and claims for which I, or they may have against Swan Cycle Park, Inc., or any of their officers, directors, workers, or employees of or by reason of any loss, damage or injury (including death) which may occur to my child and further for myself, my heirs, personal representatives, assigns, and my spouse (if married) I do agree hereby to indemnify and save harmless Swan Cycle Park, Inc., their heirs, successors and assigns, and their officers, directors, workers, employees, sponsors and all others associated with the event from any and all liability, loss, claims, demands and possible causes of action that may accrue to myself, my spouse (if married), or my child by reason of participating in activities at Swan Cycle Park, Inc.
