RELATIONSHIP WITH AWARDS. This agreement shall be read in conjunction with the award listed in clause 3. To the extent of any inconsistency between the award and this agreement, this agreement shall prevail. Where there is no inconsistency the award listed in clause 3 shall apply.
RELATIONSHIP WITH AWARDS. This Agreement regulates in total the terms and conditions of employment of employees covered by this Agreement. The parties to this Agreement intend it to be a comprehensive workplace agreement to replace all prior certified agreements, awards and Notional Agreements Preserving a State Award which may otherwise apply to the employees covered by this Agreement. Furthermore, this Agreement is intended to consolidate existing applicable awards and certified agreements into a single comprehensive document. Accordingly, this Agreement operates to the exclusion of all protected award conditions, any preserved award term and any protected notional condition, which may relate to Protected Matters. In this Clause, Protected Matters refers to provisions relating to any of the following matters:
RELATIONSHIP WITH AWARDS. 4.1 This Agreement will apply to the exclusion of any and all modern awards that may cover or apply to the Employer and Employees; and replaces any previous enterprise agreements that may have applied.
RELATIONSHIP WITH AWARDS. This agreement shall be read in conjunction with the Grocery Products Manufacturing (State) Award, provided that this agreement will prevail over this award to the extent of any inconsistency.
RELATIONSHIP WITH AWARDS. This Agreement shall be read in conjunction with the following Awards: General Construction and Maintenance Award; Clerks (State) Award; and Metal Engineering and Associated Industries (State) Award. Wherever there is inconsistency between this Agreement and the relevant Award, this Agreement shall prevail to the extent of the inconsistency.

RELATIONSHIP WITH AWARDS if, but for this Agreement, an award would apply to the employment of employees covered by this Agreement, then those terms of the award(s), as in force from time to time, are expressly excluded and have no effect in relation to the parties.
RELATIONSHIP WITH AWARDS. Just before this agreement was made, the following Award was read and interpreted in conjunction with the terms and conditions of employment of persons subject to the previous agreement. In accordance with clause 52A, Schedule 8 to the Act, the Agreement shall incorporate the following Award as at 16th May 2007 as part of the Agreement: Federal Forest & Building Products, Manufacturing & Merchandising (General) Award 1996 Provided that where there is any inconsistency between the Agreement and the Awards the Agreement shall take precedence. Therefore this Agreement operates in conjunction with and shall be read in conjunction with the Awards in respect to the terms listed under clauses 8.1 (a), save and except for the following provisions which are not incorporated into this Agreement; Federal Forest & Building Products, Manufacturing & Merchandising (General) Award 1996 Clause 7, 22.1 22A, 22.2, 22.5 28.7, Xxxxxxxx A, B, C,D, Appendix A, B,C,D,E,F,G And any other clause deemed to be prohibited content for the purposes of the Act as it existed at the time of approval of this Agreement.
RELATIONSHIP WITH AWARDS. Protected Award conditions as provided in the Wine Industry – AWU – Award and any other successor award or any other industrial instrument that may be otherwise applicable are hereby expressly excluded.
