Relationship to Parent Award and Other Legislation. This State Enterprise Agreement is the sole document governing employment conditions for the Vinidex Pty Ltd, Smithfield Site. Where the Agreement is silent on any matter the Parties will refer to the following documents in the following sequence: Local Industrial Register; Rubber Workers (State) Award (Production and Distribution employees) Metal and Engineering Industries (State). Award (Trades Emp loyees) prevailing State Legislation, or in the absence of State Legislation, the Federal Legislation will apply.
Relationship to Parent Award and Other Legislation. The conditions of this Agreement will override the conditions in the Aluminium Industry Award 2020 and any state industrial legislation if there is any inconsistency between them. The appropriate industrial legislation and regulations will apply if this Agreement is silent on any matter. However, the appropriate industrial legislation and regulations do not form part of and are not incorporated into this Agreement. The remuneration provided under this Enterprise Agreement compensates an employee for any entitlements the employee may have under any applicable modern award including, but not limited to, annual leave loading, overtime payments, weekend and holiday penalties, shift allowance, vehicle allowance, travelling expenses, first aid, meal allowance, responsibility and any other entitlement or benefit of any nature, unless otherwise specified in this Enterprise Agreement. For the avoidance of doubt, this Agreement incorporates the terms of the Aluminium Industry Award 2020 as in force from the operative date of this Agreement but only to the extent that this Agreement is silent on any matter covered by the Aluminium Industry Award 2020. This Agreement replaces and rescinds all previous Enterprise or Certified Agreements which applied or covered the “The Company” and the employees.
Relationship to Parent Award and Other Legislation. The provisions of the Rubber Workers (State) Award and the Metal, Engineering & Associated Industries (State) Award, as at the date of commencement of this agreement shall apply to the employment of the employees covered by this Agreement. The parties have agreed that the terms of the awards have been incorporated by reference into this Agreement. Copies of the said awards are attached at Appendix 5 and Appendix 6 respectively. This Agreement shall be read wholly in conjunction with the Rubber Workers (State) Award for production and distribution employees and the Metal, Engineering & Associated Industries (State) Award for trades employees, as these awards operated at the date of commencement of this Agreement. Where there is any inconsistency between the awards and this Agreement, this Agreement shall take precedence to the extent of the inconsistency. The Company agrees that no employee will, as a result of any changes to the Rubber Workers (State) Award [580] and the Metal, Engineering & Associated Industries (State) Award [039], suffer any loss of wages, conditions or other benefits. If the matters dealt with in the awards are reduced, or if the awards are otherwise stripped back or simplified, the Company agrees to continue to observe all the provisions of the awards, as they existed at the commencement date of this Agreement.   • Relationship to Parent Award This Agreement incorporates all the terms and conditions of the Award (AW825280CAV) as at 10 April 2006 with the exception of clauses 13, 16.2.1, 22.3.4, 22.3.5, 37.6 and 40.3.
