Common use of Reinstatement after Leave Clause in Contracts

Reinstatement after Leave. When a leave of absence under conditions (1), (2), (3) or (4) of Section 18.3.a. is granted for more than twelve (12) weeks, or for more than thirty (30) calendar days for any other reason, the Employer does not guarantee that the employee will be reinstated in his/her former position or to the same grade and step level when he/she is ready to return to work. That decision will be at the discretion of the Employer.

Reinstatement after Leave. When a leave of absence under conditions (1), (2), (3) or (4) of Section 18.3.a. condition “a” above is granted for more longer than twelve (12) months, or under conditions “b”, “c”, or “d” above is granted for longer than twelve (12) weeks, or for more longer than thirty (30) calendar days days, for any other reason, the Employer does not guarantee that the employee will be reinstated in his/her their former position or to the same grade and step level when he/she is ready to return the employee returns to work. That decision will be at the discretion descreation of the Co-Employer.

When a leave of absence under conditions (1), (2), (3) or (4) 1 through 6 listed in Section 5A of Section 18.3.a. this Article is granted for more than twelve (12) weeks, weeks or for more than thirty (30) calendar days for any other reasonless, the Employer does not guarantee that the employee will be reinstated in his/her their former position or to position, but reinstated at the same grade wage level and step level when he/she is ready to return to work. That decision will be at the discretion of the Employer.

That decision will be at the discretion of the EmployerDirector.
