Common use of Reinstatement after Leave Clause in Contracts

Reinstatement after Leave. Any supervisor returning from an approved leave of absence of less than six (6) months, shall be entitled to return to a position in his/her former classification within thirty-five (35) miles of the former position. For approved leaves of absence of six (6) months or more, supervisors shall be entitled to return to one of the following: • a position in the class from which the supervisor left and within thirty-five (35) miles of the former position, or • a vacancy in a related class, with the same range assignment as the supervisor's class, for which the supervisor is determined qualified by the employer, and within thirty-five (35) miles of the person's work location. An employee on an approved leave of absence is required to contact the Appointing Authority if an extension is being requested. Failure to return to work or failure to contact the Appointing Authority about an extension prior to the end of the approved leave period shall be deemed to be a voluntary resignation.
