Common use of Regulation as a Utility Clause in Contracts

Regulation as a Utility. The Seller and certain of its affiliates ----------------------- are regulated as public utilities in the States of Nevada and California. Except as set forth on Schedule 5.20, the Seller is not subject to regulation as a public utility or public service company (or similar designation) by the United States, any State of the United States, any foreign country or any municipality or any political subdivision of the foregoing.
