Reformulation/Warning Commitment. As of the Effective Date, Big Lots shall not manufacture, import, distribute, sell or offer the Products for sale in the State of California unless they are Reformulated Products pursuant to Section 2.1 or bear a warning pursuant to Section 2.3.

Notwithstanding the foregoing, Products that were supplied to third parties by Enchante prior to the Effective Date shall be deemed exempted from the requirements of Sections 2.2 and 2.3 and shall be permitted to be sold through as previously manufactured, packaged and labeled, as they were included in the calculation of civil penalties due pursuant to Section 3.1.
