Redundancy Benefits. 27.3.1 An employee whose contract of employment has been terminated by reason of redundancy shall— (a) Unless better terms are agreed between the employer and the employee concerned or the employee’s representatives, be entitled to a minimum redundancy payment of not less than two months’ basic pay for every year served on contract and other benefits the employee is entitled to as compensation for loss of employment; and (b) be paid the redundancy payment not later than the last day of duty of the employee, except that where an employer is unable to pay the redundancy payment on the last day of duty of the employee, the employer shall continue to pay the employee full wages until the redundancy package is paid. 27.3.2 As of 1st January 2001 any confirmed employee made redundant will receive one month’s notice or pay in lieu of plus a redundancy benefit of thirty two and a half (32.5) hours at the basic rate of payment at time of redundancy for every completed month of service. 27.3.3 The parties have further agreed that such amounts accrued by the employee prior to the first day of January, 2001 have been settled in full by the employer under previous agreements and in compliance with the provisions therein under the Terminal/Service Benefit/Gratuity Clause.
Redundancy Benefits. An excess employee whose employment is terminated because he or she is excess will be paid a redundancy benefit calculated at the rate of two weeks salary for each completed year of continuous service, plus a pro rata payment for completed months of service since the end of the employees last completed year of service. If this, together with a payment under clause 76.3, if any, would lead to the employee being paid less than the minimum amount to which the employee is entitled under the National Employment Standards, the redundancy benefit payable to the employee is that minimum amount. The minimum sum payable as a redundancy benefit is four weeks salary, and the maximum sum payable is 48 weeks salary. The redundancy benefit will be calculated pro rata for any period of service during which the employee has worked part-time if the employee has less than 24 years full-time service. For the purpose of calculating the employee's redundancy benefit, 'salary' will include: the employee's full-time salary, adjusted on a pro rata basis for periods of part-time service, or the salary of the higher level, where the employee has been acting in a higher level classification for a continuous period of at least 12 months immediately preceding the date on which the employee is given notice of termination, and other allowances in the nature of salary that are paid during periods of annual leave and on a regular basis, excluding allowances that are a reimbursement for expenses incurred, or a payment for disabilities associated with the performance of duties. In calculating the redundancy benefit, 'service' means: service in the Court government service as defined in section 10 of the Long Service Leave (Commonwealth Employees) Act 1976 service with the Commonwealth (other than with a joint Commonwealth-State body corporate in which the Commonwealth does not have a controlling interest) that is recognised for long service leave purposes service with the Australian Defence Force APS service immediately preceding deemed resignation under the repealed section 49 of the Public Service Act 1922 if the service has not previously been recognised for redundancy pay purposes, and service in another organisation where the employee was transferred from the APS to that organisation with a transfer of function, or the employee engaged by that organisation on work within a function is appointed as a result of the transfer of that function to the APS, and such service is recognised for l...

Redundancy Benefits. 23.9.1 Part-time employees will receive a pro-rata proportion of the following benefits.

Redundancy Benefits. (a) Redundancy or redundant means the termination or cessation of employment of an Employee for any reason. (b) The Company will become, and remain during the life of this Agreement, a member of the Redundancy Payment Approved Workers Entitlement Fund 2 ("Incolink Number 5 Fund") of which Redundancy Payment Central Fund Ltd ("Incolink") is trustee (the “Nominated Redundancy Fund”), and Employees of the Company covered by this Agreement will be enrolled in the “Nominated Redundancy Fund” and be entitled to redundancy benefits in accordance with the terms of the relevant Trust Deed. (c) The Company shall pay contributions to the Nominated Redundancy Fund on behalf of each Employee, including apprentices and casuals covered by this Agreement, calculated on a weekly basis and paid in accordance with the Trust Deed. (d) The liability of the Company to pay redundancy benefits to an Employee under this Agreement will be met to the extent that contributions are made by the Company in respect of that Employee to the Nominated Redundancy Fund. (e) References in this clause to “Nominated Redundancy Fund” include a reference to another fund for comparable purposes for the purpose of this Agreement as a fund which supersedes the Incolink No 5 fund.

Redundancy Benefits. 39.1 The parties to this Agreement acknowledge that termination of employment shall be in accordance with Appendix 9, item 2 plus the redundancy benefits of this clause. 39.2 The Company shall pay $90.00 per week into an agreed Redundancy Fund. This amount is fixed for the life of the Agreement. The Company may offset the cost of all notice and redundancy payment obligations against the amount they have contributed into the Fund when making redundant Employees with 5 years service or more, providing they have paid into a fund throughout the period of employment. All other Employees will be given one week’s notice or one week in lieu of notice in addition to the proceeds of the money paid into the Fund in the event of being made redundant. 39.3 In the event of redundancy resulting from a reduction in available work the current established procedures as set out in Appendix 7 shall continue to apply.
Redundancy Benefits. 7.4.1 Retrenched employee(s) shall be eligible to receive redundancy benefits as detailed in Schedule 3 (Redundancy Entitlements). 7.4.2 These redundancy provisions apply only to permanent employees.
