Reductions in Payments Due. Amounts due the Department by Contractor, including liquidated or other damages, or claims for damages, may be deducted or set off by the Department from any money payable to Contractor pursuant to this Contract.
Reductions in Payments Due. Amounts due the Counties by Contractor, including but not limited to liquidated or other damages, or claims for damages, may be deducted or set-off by the Counties from any money payable to Contractor pursuant to this Agreement.
Reductions in Payments Due. Amounts due AOC by Contractor, including but not limited to liquidated or other damages, or claims for damages, may be deducted or set-off by AOC from any money payable to Contractor pursuant to this Contract. AOC shall provide Notice to Contractor of any such deduction or set-off.

Amounts due DHS by Contractor under this Contract, including but not limited to liquidated damages or any other damages caused by any deficiency or delay in the Services or Deliverables may be deducted or set-off by DHS from any money payable to Contractor pursuant to this Contract. If set-off such amounts within five Days of the date of DHS’ s sending an email to the Contractor Project Manager describing such failure, DHS may exercise this right, and DHS shall provide Notice to Contractor of any such deduction or set- off. Or DHS may direct the Contractor to make payment directly to DHS for such amounts due. The method of collection of such amounts due is solely and strictly at DHS’ s discretion.

State shall provide Notice to Contractor of any such deduction or set-off.

Amounts due the Exchange by Contractor, including but not limited to liquidated or other damages, or claims for damages, may be deducted or set-off by the Exchange from any money payable to Contractor pursuant to this Agreement. The Exchange shall provide Notice to Contractor of any such deduction or set-off and ten business days opportunity to cure the breach resulting in such damages or resolve the claims for damages prior to exercising such deductions or set-offs.
