Reduce to Writing. In the event a grievance arises, it shall be reduced to writing and specify the act or event being grieved, the date of the occurrence, the identity of the Employee or Employees who claim to be aggrieved, the provisions of the Agreement that allegedly have been violated, and the remedy sought. It will be handled as outlined in Section 5.

Reduce to Writing. If the matter is not resolved at the meeting to the satisfaction of the complainant, he/she shall put the complaint in writing and submit the original to the unit member, with a copy to the unit member’s immediate supervisor. The unit member shall be given time during the non-student contact time, without salary deduction, to review the complaint. If a unit member believes the complaint is false and/or based on hearsay, and the District decides a record should be maintained, a grievance may be initiated to determine the validity of such complaint. If not written complaint is received, the matter shall be dropped.

  • Notice to State The MCO must notify the STATE of a possible Material Modification in its Provider Network within ten (10) working days from the date the MCO has been notified that a Material Modification is likely to occur. A Material Modification shall be reported in writing to the STATE no less than one hundred and twenty (120) days prior to the effective date or within two (2) working days of becoming aware of it, whichever occurs first. An MCO may terminate a subcontract without one hundred and twenty (120) days’ notice in situations where the termination is for cause. For purposes of this section, termination of a Provider for cause does not include the inability to reach agreement on contract terms.

In the event Ensign Group elects to request an ALJ hearing, the Stipulated Penalties shall continue to accrue until Ensign Group cures, to OIG’s satisfaction, the alleged breach in dispute. Failure to respond to the Demand Letter in one of these two manners within the allowed time period shall be considered a material breach of this CIA and shall be grounds for exclusion under Section X.D.
