Recovery Services. Clients may access recovery services after completing their course of 28 treatment to prevent relapse. Recovery services may be provided face-to-face, by telephone, or by 29 telehealth with the Client and may be provided anywhere in the community. Recovery services shall be 30 made available to DMC-ODS beneficiaries when a Medical Director or LPHA has determined that 31 recovery services are medically necessary in accordance with their individualized treatment plan. The 32 components of Recovery Services are:
Recovery Services. Recovery Services are the services necessary to recovery operations and the resumption of day- to-day business critical operations from both planned and unplanned events. These services may require snapshots in time, real-time duplication, archival services as well as other backup type solutions. Respondent solutions should provide a variety of options and also take into account new technologies (e.g. server virtualization) as they emerge with the following guidelines: The Department has the ability to update state contracted services defined herein at any time over the term of the contract, except when the Department is experiencing a disaster. Such updates shall be handled in accordance with the terms and conditions defined herein. The Eligible User Recovery Services and/or Network Services Schedules shall be defined in an Eligible Users Statement of Work (SOW). The SOW shall specify a location and the recovery services required by the Eligible User. The Eligible User may select the services needed from the Vendor‘s catalog of available services. When the Eligible User declares a Disaster, the Recovery Services provided by the Service Provider to the Eligible User may include the following services and shall be selected by the Eligible User and documented in an agreement between the Eligible User and the Provider: o Center-Based Recovery Services: These sites shall provide conditioned office space facilities that are located close to an agency's core operations and enable personnel to relocate to the Provider‘s facilities and quickly resume operations in the event of a disaster or disruption at the agency's location. To support recovery from the disaster or disruption, elements of the service may include: Fully-operational computers with networking capability ("hot sites") Environmentally-prepared computer space, properly equipped to support installation of computer systems ("cold sites") Communication services Network services In addition to space, equipment, and voice and data communications lines, Center-Based Recovery Services may also include complete call center voice recovery, with call recording and customer support functions. o Hot-site: This is a duplicate of the original site of the Eligible User, with full computer systems as well as near-complete backups of user data. Recovery Services. Provided You are in compliance with the terms of the Agreement and this Exhibit B, Cysurance will provide funds or services to remediate and/or replace any aspect of the Participant’s environment in which the Event occurred, including, but not limited to, a xxxxxx attack, business email compromise, data breaches, physical tampering, participant downtime, or other related costs specified in the Cybersecurity Service Warranty Confirmation Summary attached hereto as Schedule 1. Participant must provide Cysurance with Service Data deemed to be sufficient by Cysurance to support the damages incurred as a result of the Event, such determination to be made in Cysurance’s reasonable discretion, within fifteen (15) days after discovery of the Event; otherwise the Event will be treated as an invalid Event that is ineligible for Recovery Services pursuant to the terms of this Exhibit B.
Recovery Services. At all times during the Term, Contractor shall maintain written plans and procedures designed to prevent the introduction of Malicious Code into AOC’s or Customers’ environment or any System used to provide the Services, which such measures shall include plans to notify and update AOC and Customers of such introduction and to mitigate the effects thereof. Contractor shall notify AOC and Customers expeditiously of any Malicious Code in any such environment or System of which it becomes aware and mitigate the effects in accordance with such written plans and procedures. Without limiting Contractor’s other obligations under this Agreement, in the event Malicious Code is found in Software or Systems managed or supported by Contractor or used by Contractor to provide the Services, Contractor shall, except as expressly set forth below, at no additional charge to AOC and Customers, eliminate or permanently quarantine such Malicious Code and reduce the effects of such Malicious Code and, if the Malicious Code causes a loss of operational efficiency or loss of data, mitigate such losses and restore such data with generally accepted data restoration techniques (“Malicious Code Recovery Services”). Contractor shall provide all Malicious Code Recovery Services at no additional Charge. The Parties anticipate that Malicious Code Recovery Services requested by AOC or Customers shall be provided by Contractor without adversely affecting Contractor’s ability to meet its performance obligations.
Recovery Services. 19.4.1 Recovery Services are to be offered to beneficiaries when a Medical Director or LPHA has determined that recovery services are medically necessary and after the beneficiary has been discharged from a SUD treatment provider. Services shall be made available to DMC-ODS beneficiaries in accordance with their individualized treatment plan. This may include the plan for ongoing recovery and relapse prevention that was developed during discharge planning when treatment was completed. Services shall not be provided while the beneficiary is receiving SUD treatment services. Recovery services shall be utilized when the beneficiary is triggered, when the beneficiary has relapsed, or simply as a preventative measure to prevent relapse. Documentation of progress notes shall follow the DMC-ODS Documentation standards and recorded in the beneficiary’s file. Services may be provided by a Licensed Practitioner of the Healing Arts (LPHA), Counselor, or Peers (for substance abuse assistance) acting within their scope. Services may be provided either face-to-face, by telephone, or by telehealth, and in any appropriate setting in the community with the beneficiary where confidentiality is maintained.

Recovery Services. Claim Recovery Services. United will provide recovery services for Overpayments and other Plan recovery opportunities as described herein. United will not be responsible for reimbursement of any unrecovered Overpayment nor attorneys’ fees and costs related to litigation or arbitration associated with recoveries except to the extent an arbitrator, arbitration panel, or court of competent jurisdiction determines that the Overpayment was due to United’s gross negligence or willful misconduct. Under no circumstances will United be responsible for reimbursement of unrecovered Overpayments resulting from a third party’s fraud. Overpayments. United utilizes generally-accepted auditing protocols to identify Overpayments. United will attempt to recover Overpayments by employing appropriate outreach to Participants and/or providers to request reimbursement. Fraud, Waste, and Abuse Management. United will provide services related to detection, and recovery of wasteful, abusive, and/or fraudulent claims. United’s Fraud, Waste, and Abuse Management processes will be based upon United’s proprietary and confidential procedures, modes of analysis, and investigations. United will use these procedures and standards in delivering Fraud, Waste, and Abuse Management services to Customer and to United’s other customers. Services include all work to identify recovery opportunities, research, data analysis, investigation, and initiation of all Recovery Processes set forth below. United does not guarantee or warranty any particular level of prevention, detection, or recovery. United agrees to perform Fraud, Waste, and Abuse Management services pursuant to the industry standards for such services. Credit Balance Recovery. United utilizes on-site resources to perform hospital and/or facility audits to review, validate, and recover credit balances (dollars) existing on patient accounts to identify any recoverable amounts. Hospital Xxxx Audit. United utilizes on-site resources (registered/licensed nurses and/or certified coders) to perform in-depth reviews of hospital bills. Auditors will conduct line by line comparisons of itemized bills to the medical records to ensure billing accuracy and identify any recoverable amounts. Subrogation. United will provide services to recover Plan benefits that were paid and are recoverable by the Plan because payment was or should have been made by a third party for the same medical expense (other than in connection with coordination of benefits, Me...
