RECOGNITION EXCLUSIONS. 1.01 The employer recognizes the Union as the sole and exclusive bargaining representative of the office clerical employees of the Employer for the purpose of collective bargaining in respect to wages, hours and all other working conditions. For the purpose of this agreement, the term “employees” shall not include and the union shall not accept for membership, direct representatives or agents of the Employer such as the President, Financial-Secretary-Treasurer, Maintenance employees, National Union Representative assigned to the employer, except in the event that in future a member or members of the Union should become a National Representative or paid official of the National Union.

RECOGNITION EXCLUSIONS. The Company recognizes the Union for the duration of this Agreement as the sole bargaining agent for all employees in its plant in Wallaceburg. Ontario, save and except supervisors, persons above the rank of supervisors, and office staff, and it is mutually agreed and understood that the bargaining unit does not include direct representatives of management such as: superintendents, timekeepers, engineering and metallurgical personnel and nurses. The Company will negotiate with the Union for the purpose of adjusting any disputes which may arise concerning wages, hours and conditions. The Union agrees that Local United Automobile, Aerospace and Agricultural Implement Workers of America is a branch thereof, chartered by and in good standing with it, and acknowledges its responsibility to the Company for the acts of the Local, its officers, agents and representatives pertaining to this Agreement or branch thereof, as fully as though such acts were its own acts.

The Company will (unless otherwise required by law) negotiate at all necessary in the provided herein, with chosen accredited representative of its employees for the purpose of any which may arise as to wages, hours, working conditions, discrimination and dismissals.

The Company and the Union agree that, if the incumbent staff Storekeeper leaves the position for any reason, his present bargaining unit function will not continue to be performed by a staff person and that supervisory personnel may continue to supplement bargaining unit stores personnel during peak periods or on off-shifts when a full time bargaining unit job is not justified. Under normal conditions, employees outside the scope of the bargaining unit to which this Agreement applies, shall not do work which is customarily per- formed by members of the bargaining unit. This shall not apply to staff employees who are engaged in: training employees experimental work work which is required due to emergency conditions beyond the control of the Company. Outside contractors will not perform bargaining unit work. The Company, however, does reserve the right to use outside contractors: on jobs that are capital in scope and beyond the availability of bargaining unit personnel on jobs that require excess manpower for a short period of time (However, the Company agrees that they shall not use contractors if it is possible to utilize laid off employees.) on jobs that involve detailed mechanical or elec- trical repairs of major importance requiring warranties. on jobs of an emergency nature where qualified bargaining unit employees are not available. NO DISCRIMINATION There shall be no discrimination, interference, restraint or coercion by the Company, the Union, or any of their respective agents against any employee because of membership in or legitimate activity on behalf of the Union or because of race, colour, gender or religious creed.
