RECOGNITION (continued). 2.06 The articles of the collective agreement will apply to both the Outside and Office work units unless specifically indicated otherwise. Specifically, the subheadings “Outside Unit” or “Office Unit” preceding an article, or the reference to “outside employees” or “office employees” within an article, shall denote a provision applying either to the Outside work unit or to the Office work unit, respectively.
RECOGNITION (continued). 2.03 During the effective period of this Agreement, its terms, except for error or omission, shall be applicable to all Members of the Bargaining Unit.
RECOGNITION (continued). 3.07 a) The Union shall notify the Board as to the members of its Negotiating Committee, Grievance Committee, Labour Managemement Committee, Training Committee and Union Executive, and the Board shall not be required to recognize any person as such a Committee or Executive member until so notified.
RECOGNITION (continued). 3.09 If the Board requires an Employee to meet with his/her supervisor in order to receive a formal reprimand, suspension, or discharge, the supervisor will inform the Employee that he/she has the right to have an Union representative present.

RECOGNITION (continued). SECTION 3. Only full-time permanent employees will be represented by this Union that come within the jurisdiction of this Agreement. Part time and seasonal employees are excluded from the bargaining unit. The number of hours that establish Part time employment shall be defined by the City. Seasonal employees are defined as those employees who are hired for limited periods of time not to exceed six months including employees sponsored by the jobs training partnership act (JTPA) and Michigan Youth Corps (MYC) or other federal or state jobs programs. Where Union concurrence is required prior to City participation in JTPA or MYC programs, the Union shall not withhold such concurrence and specifically shall not do so as a result of a dispute with the City over grievances or contract negotiations.
RECOGNITION (continued). 3. Teachers holding bachelor’s degree only, who end the school year as a permanent (60 day) substitute and who are subsequently hired into any teaching position, will be placed at Step 1.5 on the BA salary schedule unless they work at least 1 ½ semesters in one position, which would then qualify them for Step 2 of the BA salary schedule.
RECOGNITION (continued). It is the mutual understanding and intent of the Board and of the Association that the above language shall be interpreted so as to protect the Board and the District from incurring any costs or expenses whatsoever with regard to any tenure hearing or other related appellate or collateral proceeding in any court, administrative agency or other forum arising out of any attempt by the Board to comply with the provisions of the Agency Shop/Dues Deduction provisions of this Agreement, such as attorneys' fees, witness' fees, court reporter's costs, transcript expenses and costs of any unemployment compensation. In the event of any action against the Board brought in a court or administrative agency because of its compliance with this Article, the Association agrees to defend such action, at the Association's expense and the Association's counsel, provided:

Provided the Association files such a request with the Board within ten (10) workdays after receipt of such notice, the Board will meet with representatives of the Association. The Association may present its views on the proposed policy(s) to the Board at this meeting. It is the intent of this clause to provide the Association with an opportunity to express its opinions which will not be binding on the Board. Such policy shall not be adopted until the regular Board meeting following the notification to the Association.
