RECOGNITION AND SCOPE OF AGREEMENT SECTION 1. RECOGNITION. (a) Each Employer signatory to this agreement, whether as a member of the Association or as an Individual Employer, hereby acknowledges that, following a request by the Union for recognition as the majority collective bargaining representative under Section 9 (a) of the National Labor Relations Act, the Employer has recognized the Union as the Section 9 (a) majority collective bargaining representative for all of the Employer’s employees performing unit work based upon a showing by the Union of, or based upon an offer by the Union to show evidence that a majority of the Employer’s employees authorize the Union to represent them in collective bargaining. The Employer further agrees that it is establishing, or has previously established, a collective bargaining relationship by this agreement within the meaning of Section 9 of the National Labor Relations Act of 1947 as amended.
