Recall Rights and Procedure. 1. If the Superintendent should decide to terminate the employment of an employee serving at the discretion of the Superintendent (a professional status teacher) because of a decline in pupil enrollment, budgetary constraints or programmatic changes, the Superintendent shall deliver to the employee a written notice of termination which will affirmatively set forth: (1) the date of termination and (2) a statement that such termination is because of a decline in pupil enrollment, budgetary constraints or programmatic changes, and (3) the areas within which the said employee is then certified to teach according to the records of the District.

In the event an employee performs auxiliary work during period of layoff, the auxiliary time worked will be added to the one year period of recall eligibility specified in Article Recall shall in order of service seniority, regular employees preceding auxiliary employees, providing the regular employee has the necessary qualifications, ability and experience to fill the position and the recall would not constitute a promotion. In the event the employee is recalled to his former position or to a position at the same pay level as his former position, the employee, at the time of recall, will be placed at the same step in the pay level that he was in at the time of layoff.
