The parties intend that promoted positions in Emergency Services will be made as a result of the competitive testing process outlined in this agreement. As an example, if the Department Head appoints a firefighter from Emergency Services to a Fire Investigator position, the Firefighter will be paid at the Driver/Operator rank of pay. If that Firefighter wishes to return to an Emergency Services assignment at the end of the commitment for the Fire Investigator position, that Firefighter will do so at his/her previous tested classification unless the Firefighter competes for and achieves a promotion to the rank of Driver/Operator while in the Support Services assignment/role. In consideration of making an appointment within this rank structure, the Department Head shall seek to make any appointment from the same rank classification first. If unable to fill the open position from the same classification, the Department Head may consider personnel from the rank classification directly below that of the classification of the open position only. Serving in a Staff/Administrative role in no way prevents personnel from competing for promotion, but successfully gaining said promotion does not immediately create a condition in which they would be transferred back to an Emergency Services assignment.

RANK STRUCTURE. ‌ The Portsmouth Police Department will be structured in the following manner: Each shift and the Detective Division will have one Lieutenant and one Sergeant. The Department shall also have an Administrative Officer who shall hold the rank of Lieutenant. The Lieutenant and Sergeant positions in the Patrol Division will be filled by the promotional procedure set forth in Article VI of this contract. From highest ranking to lowest ranking, the rank structure of the Department is as follows: Chief, Deputy Chief, Lieutenant, Sergeant, Detective Inspector, Senior Patrolman, Junior Patrolman, and Probationary Patrolman. When a vacancy occurs in the position of Detective Lieutenant, Administrative Lieutenant or Detective Sergeant, the following procedure will be followed: When the position of Administrative Lieutenant, Detective Lieutenant, or Detective Sergeant becomes vacant, a second promotional meeting will occur after all Sergeant and Lieutenant positions are filled. Said meeting will occur only after notice of said meeting has been posted on the desk bulletin board at police headquarters for at least five days prior to the date set for said meeting. The Deputy Chief shall ensure that all eligible officers are notified of the meeting and their right to sign up. The five day posting rule can be waived if all eligible officers have been personally notified by the Chief or Deputy Chief and given the opportunity to sign up for said appointment. The Chief and Deputy Chief will meet, unless on leave, to discuss the appointment(s) of Detective Lieutenant and/or Administrative Lieutenant. The Chief, Deputy Chief and all department Lieutenants will meet, unless on leave, to discuss the appointment of a Sergeant to the position of Detective Sergeant. Within forty-eight (48) hours of the conclusion of the meeting the Chief will decide which officer will be recommended to the Town Administrator for appointment to said position and all applicants will be notified of the decision forthwith. The Town Administrator shall ratify the appointment as recommended by the Chief if the Town Administrator is satisfied that the decision of the Chief is based on good and sufficient facts. If none of the eligible police officers wish to become a Detective Lieutenant, Administrative Lieutenant, or Detective Sergeant, the most junior officer of the respective rank will be appointed to the undesired position.   • Classification Structure All employees working under this Agreement shall be classified according to the skill based classification structure set out in Appendix A.

  • Organizational Structure The ISO will be governed by a ten (10) person unaffiliated Board of Directors, as per Article 5 herein. The day-to-day operation of the ISO will be managed by a President, who will serve as an ex-officio member of the ISO Board, in accordance with Article 5 herein. There shall be a Management Committee as per Article 7 herein, which shall report to the ISO Board, and shall be comprised of all Parties to the Agreement. There shall be at least two additional standing committees, the Operating Committee, as provided for in Article 8, and the Business Issues Committee, as provided for in Article 9, both of which shall report to the Management Committee. A Dispute Resolution Process will be established and administered by the ISO Board in accordance with Article 10.

Verizon will work with Customer to confirm that a DDR issue exists with the Core Network and repair the problem(s), as applicable. Once Verizon confirms that the DDR on the Core Network for a specific Customer E-Line EVC connection does not comply with this Service Level Standard, Verizon will have thirty (30) calendar days from the opening of the Trouble Ticket to address the Service Issue and close the applicable Trouble Ticket before Customer may be eligible for SLA credits. If, after thirty (30) calendar days of opening the Trouble Ticket, the DDR Service Level Standard issue is not corrected, but has been agreed to as a Service Issue, Customer may qualify for credits.

  • Governance Structure The Academy shall be organized and administered as a Michigan nonprofit corporation under the direction of the Academy Board and pursuant to the governance structure as set forth in the Bylaws. The Academy’s Board of Directors shall meet monthly unless another schedule is mutually agreed upon by the President and the Academy. The Academy shall not delegate this duty of organization and administration of the Academy without the express affirmative consent of the University.

  • Capital Structure (i) The authorized capital stock of the Company consists of 10,000,000,000 shares of Common Stock, of which, as of January 31, 2004, 2,719,301,543 shares are outstanding, and 1,000,000,000 shares of Preferred Stock, par value $.01 per share, of which, as of the date of this Agreement, 207,537 shares of Series C Preferred Stock and 25,428 shares of Series E Preferred Stock are outstanding. All of the outstanding Shares have been duly authorized and are validly issued, fully paid and nonassessable. The Company has made available to Cingular prior to the date of this Agreement true and complete copies of the Rights Agreement, the DoCoMo Investor Agreement and the DoCoMo Warrant Agreement, each as amended.
