Railways. 21 (1) The Proponents may in accordance with approved proposals use rail or road or rail and road transport for the carriage of inputs necessary for the Project and of finished products, partly finished products and waste products of the Project between the Mine Sites the Plant Sites and the port used from time to time for the imports and exports required for the Project. Any requirement in respect of rail transport contained in approved proposals is referred to in this Clause as “the Proponents’ rail transport requirements”.

(1) At any time after the commencement date the Company may give notice to the State that it requires the construction of a railway from the crushing plant in the next following clause mentioned to the boundary of the works site and upon receipt of such notice the State shall if the making of the railway has then already been authorised by the said Parliament forthwith commence to construct and as soon as conveniently may be and in any event within two years after such receipt will complete and will thereafter so long as the Company uses the railway as contemplated by this agreement will provide funds for the operation and maintenance of a 3 feet 6 inches or wider gauge single railway (hereinafter called “the direct railway”) from the said crushing plant to the works site following generally the route of the proposed railway appearing in the Plan commonly known as the Xxxxxxxxxx Plan from Mundijong to Kwinana. If the making of the direct railway has not already been so authorised the State will seek the authority of the said Parliament thereto and forthwith after the authority is given will commence and thereafter will complete the railway as aforesaid.

Railways. Without prejudice to its proprietary rights over the railways within its boundaries and its control of the railway administration, the Free Territory may negotiate with Yugoslavia and Italy agreements for the purpose of ensuring the efficient and economical operation of its railways. Such agreements would determine where responsibility lies for the operation of the railways in the direction of Yugoslavia or Italy respectively and also for the operation of the railway terminal of Trieste and of that part of the line which is common to all. In the latter case such operation may be effected by a special commission comprised of representatives of the Free Territory, Yugoslavia and Italy under the chairmanship of the representative of the Free Territory.
Railways. CIIAPTER I. FREEDOM OF TRANSIT TO THE ADRIATIC FOR HUNGARY. ARTICLE 294. Free access to the Adriatic Sea is accorded to Hungary, who with this object will enjoy freedom of transit over the territories and in the ports severed from the former Austro- Hungarian Monarchy. Freedom of transit is the freedom defined in Article 268 until such time as a General Convention on the subject shall have been concluded between the Allied and Associated Powers, whereupon the dispositions of the new Convention shall be substituted therefor. Special conventions between the States or Administrations concerned will lay down the conditions of the exercise of the right accorded above, and will settle in particular the method of using the ports and the free zones existing in them, and the railways ordinarily giving access thereto, the establishment of international (joint) ervices and tariffs, including through tickets and way bills, and the maintenance of the Convention of Berne of October 14, I890, and its supplementary provisions until its replacement by a new Convention. Freedom of transit will extend to postal, telegraphic and telephonic services. CHAPTER II.
Railways. (1) Before the end of the year 1968 the State shall construct and thereafter so long as the Company uses the line as contemplated by this Agreement the State shall operate and maintain a standard gauge line from a point or points reasonably practicable and mutually agreed upon at or near and servicing the Company’s storage bins established on the leased areas to the works site via Southern Cross and Cannington in the said State. The State will if requested by the Company construct and maintain at the cost of the Company on the leased areas such loops spurs and sidings as may be mutually agreed in order to assist in the efficient loading and transport of the ore.
