QUANTITIES AND PRICE. The specific quantity ordered must be delivered in full and not be changed without MDT's prior written consent. Any different quantity without such consent is subject to MDT's rejection and return at Supplier's expense and MDT shall have no obligation for payment of any excess quantity. The price for the Products and/or Services shall be the price as indicated on the face of this PO. Any change in price without MDT's prior written consent and issuance of an amended PO is expressly rejected. No additional charges of any kind will be allowed except with MDT's prior written consent.

QUANTITIES AND PRICE. Unless agreed otherwise between the Parties, the quantities stated in the Order are an estimate only and should not be relied upon by the Buyer as being representative of the actual quantities. Where and to the extent that the actual quantities manufactured or supplied vary by more +/‐ 5% of the quantities set out in the Order, the Company reserve the right to revise or amend its unit rates and prices to reflect the divergence.   • Quantity If Seller delivers more than the quantity of Goods ordered, Buyer may reject all or any excess Goods. Any such rejected Goods shall be returned to Seller at Seller's risk and expense. If Buyer does not reject the Goods and instead accepts the delivery of Goods at the increased or reduced quantity, the Price for the Goods shall be adjusted on a pro-rata basis.

  • Quantities The estimated quantities provided by the City are not guaranteed. These quantities are listed for informational purposes only. Quantities vary depending on the demands of the City. Any variations from the estimated quantities shall not entitle the bidder to an adjustment in the unit price or any additional compensation.

  • Product Specifications The Company agrees that all Products sold to Xxxx hereunder shall conform to the respective specifications set forth on Schedule A or to such other specifications as are from time to time agreed upon by the Parties.

  • Prices Prices are firm and not subject to escalation, unless otherwise specified in the invitation for bid.

  • Facilities and Equipment Except as set forth herein, Consultant shall, at its sole cost and expense, provide all facilities and equipment that may be necessary to perform the services required by this Agreement. City shall make available to Consultant only the facilities and equipment listed in this section, and only under the terms and conditions set forth herein. City shall furnish physical facilities such as desks, filing cabinets, and conference space, as may be reasonably necessary for Consultant’s use while consulting with City employees and reviewing records and the information in possession of the City. The location, quantity, and time of furnishing those facilities shall be in the sole discretion of City. In no event shall City be obligated to furnish any facility that may involve incurring any direct expense, including but not limited to computer, cellular telephone, long-distance telephone, or other communication charges, vehicles, and reproduction facilities. If the performance of the work specified in Exhibit A requires destructive testing or other work within the City’s public right-of-way, Consultant, or Consultant’s subconsultant, shall obtain an encroachment permit from the City.
